David JURCIC no contest pleas to 
third-degree murder, kidnapping, rape, sexual  assault 1984

Oct. 17, 1984 McDonald PA Record-Outlook:

A Cecil Township man has been sentenced to six to 20 years in prison after pleading no contest to a charge of third-degree murder in the 1983 shooting death of his adoptive mother.

David JURCIC, 21, also entered pleas of no contest Wednesday to charges that he kidnapped, raped and sexually assaulted his 20-year-old girlfriend.

JURCIC told Allegheny County Common Pleas Judge Bernard L. MCGINLEY that a "mistake was made" and that the shooting of his mother, Elizabeth JURCIC, had been accidental.

Defense attorney Patrick J. THOMASSEY said his client pleaded no contest rather than guilty because he could not admit to killing his mother intentionally.

According to a summary of evidence presented by Assistant
District Attorney James WILSON, JURCIC and his mother went to his girl friend's Bridgeville home on October 24, 1983, to return the couples' 14 month-old daughter. The child had been visiting Mrs. JURCIC.

During a preliminary hearing, JURCIC's girlfriend, who was not
identified, testified that JURCIC pulled out a gun and told her he had to talk to her. The couple had broken up three months earlier, she said.

JURCIC said that as the two struggled, Mrs. JURCIC tried to pull her away. She said that JURCIC beat his mother in the face, and then shot her in the head.

The woman said he then abducted her and took her to an isolated spot in Oakdale, where he raped her. She told police that he eventually broke down, cried and let her go.
