Frederick Hess Will, Greene? Township,14 February 1857

In the name of God Amen, I, Frederick Hess of Quinzy Township Franklin
County, Pennsylvania being weak in body but of sound and disposing mind,
memory and ???? considering the certainty of death and the uncertainty of
the ???? do make and publish this my last will and testament in manner
following to Wit, First and principaly I commit my ????? the discretion of
My Executor herein after named, and after my just debts and funeral Expences
are first paid, I give & bequeath as follows. Item - I give and bequeath to
my beloved wife Nancy if she should survive me All my moveable Goods or
Chattles, or as many of them as she may choose, to be hers absolutely. I
also Will her the use and possession of all that tract a portion of Land and
premises, joining Jacob Middower, the road to Town and Jonathan Mentzer, now
in the occupancy of Abraham Snowberger?, also one lot of Mountain Land
Joining Gabrial Barc, Jacob Miller and others to have the use and income of
the same, for her support and maintenance during her lifetime, by her paying
the taxes, and necessary repairs on the same during said period, I further
order and direct that after the death of my Wife aforesaid, the two tracts
or portions of land herein before mentioned are to be valued and Appraised
by Abraham Stamy?, Jacob Price and my son Jacob Hess.

Item- My Will is that my son Israel Hess is to have or take at the valuation
or appraisement of said three appraisers all the aforesaid two Tracts or
portions of Land and premises, if he chooses to do so. And if said Israel
declines taking as aforesaid, My Will is that said two tracts of Land and
premises, are to be sold at public sale by my Executor herein after named.

Item - I further Will and bequeath unto my sons, Frederick Hess, John Hess,
Jacob Hess, Jeremiah Hess, Isreal Hess and to my daughters, Polly
intermarried with Daniel Baker?, Nancy intermarried with Isreal Strite,
Elizabeth Hess, Hannah intermarried with Felix Singer, Sarah intermarried
with Samuel Strite, Catherine intermarried with Abraham Snowberger, and
Barbary Hess. All of them share and share alike, of all my Estate real and
personal, after the death of my Wife Nancy aforesaid, Including all the
moneys, goods and effects which each of them have received and will receive
from me in my lifetime, which amounts are all to be accounted for.

Item - It is further my will in addition to the foregoing that My Executor
herein after named is payed to my youngest daughter Barbary when she arrives
to the age of Twenty one years as much money as will equal her ??? with the
rest of my daughters as she has not got to equal her with the rest from ????
of my wife Nancy, she & all the rest as aforesaid are to have equally of my
Estate as aforesaid. And lastly I do hereby constitute appoint my son Jacob
Hess to be my sole Executor of this my last will and testament, revoking and
annuling all former Will by me heretofore made. Rattifying and confirming
only this my last Will and Testament, -
In Testimony whereof I have here unto set my hand and seal this fourteenth
day of February in the year of our lord one thousand eight hundred and fifty
seven.
