Frederick Hess Will, 7 January 1828

In the name of God, Amen, I Frederick Hess of Letterkenny Township Franklin
County and State of Pennsylvania being in good health of body, and of sound
and disposing mind memory and understanding (thanks be to God fore the same)
and being desirous to settle my worldly affairs, in order, I do make and
publish this my last will and testament. First and principally I commit my
soul into the hands of my creator who gave it, and my body to the earth, to
be buried in a decent manner, and as to such worldly estate which it hath
pleased the Allmighty God to bestow unto me, I dispose of in the following
manner to wit: I will that all my just and lawfull debts if there is any at
my death, together with my funeral expenses shall first be paid and
satisfied out of my personal estate. I will and bequeath unto my beloved
wife Catharina all my real and personal estate during her life, and after
her death I direct that my real estate to be sold by my Executors herein
after named (or the survivors of them) for the best price the same may
bring, the terms of sale to be, the one half in hand, and the residue in six
equal annual payments without interest - I give and bequeath unto John
Lochbaum, a nephew of my wife Catharina, the sum of four hundred dollars,
out of the hand money to be raised by the sale of my real estate - Item I
give and bequeath unto my nephew Frederick Hess son of John Hess, the one
sixth part of the residue of the proceeds of the sale of my real estate -
Item I give and bequeath unto my nephew Samuel Hess, one other sixth part of
the residue of the proceeds of the sale of my real estate - Item my will
further is that Susanna the wife of Samuel Hess shall have the one third out
of the last bequeath in this will bequeathed to Peter Benedict of the
residue of my estate, and the balance said Peter is to have as lastly stated
- Item I give and bequeath unto my nephew Abraham Hollinger one other sixth
part of the residue of the proceeds of the sale of my real estate - Item I
give and bequeath unto my nephew John Hollinger, son of Jacob Hollinger, one
other sixth part of the residue of the proceeds of the sale of my real
estate - Item I give and bequeath unto my nephew John Hollinger, son of
Philip Hollinger, one other sixth part of the residue of the proceeds of the
sale of my real estate - Item I give and bequeath unto my nephew Samuel
Hollinger, son of Philip Hollinger remaining sixth part of the residue of
the proceeds of the sale of my real estate - and lastly I give and bequeath
unto my brother in law Peter Benedict after the death of my wife Catherina
the residue of my estate, excepting the third coming to Susanna as above
stated - I hereby make and ordain my brother in law Peter Benedict and my
friend and neighbor Benjamin Hoover Executors of this my last will and
testament, hereby revoking and making void all former wills by me at any
time heretofore made - In witness whereof I the said Frederick Hess, have
hereto set my hand and seal this seventh day of January in the year of our
Lord one thousand eight hundred and twenty eight.

Franklin County. On this 26th day of August A.D. 1834 Personally appeared
before me Paul I. Hetich Register vc in for said County John Rothbaust &
Frederick Miller the witnesses the foregoing & within instrument of writing
who being duly sworn according to law did depose & say that they were
present & saw Frederick Hess now deceased write his name unto & heard him
publish pronounce & declare the same as & for his last will & testament &
that at the time of the signing thereof the said deceased was of sound &
disposing mind memory & understanding according to the best of their
knowledge & belief & that their names thereto subscribed as a witness is in
their own pen per hand writing & done at the same time. Sworn & subscribed

1st September 1834. You Benjamin Hoover do solemnly sincerely & truly
declare & affirm (as Executor of the estate of Frederick Hess late of
Letterkenny Township deceased) you will and truly administer the goods and
chattels, rights and credits of said deceased according to law, and also
will diligently and faithfully regard and will and truly comply with the
provisions of the law relating to collateral inheritances. Before Paul I.
