Benjamin Chambers late of Guilford to Samuel Findlay of Peter's Township,

ROBERT SEMPLE Esquire high Sheriff of the County of Cumberland in the
Province ofPennsylvania To all to whom these Presents shall come Greeting.
WHEREAS Thomas Minshall Assignee of John Hare lately in the Court of Common
Pleas held at Carlisle in the County aforesaid before the Justices of the
same Court, to wit / of the Term of April which was in the fourteenth Year
of the Reign of George the third King of Great Brittain France & Ireland &
by his plaint and by the Judgement of the same Court recovered against
Benjamin Chambers late of Cumberland County Yeoman otherwise called Benjamin
Chambers late of Guilford in County of Cumberland & Province of
Pennsylvania, as will a certain Debt of Eight hundred and twenty Pounds
Lawful Money of Pennsylvania as fifty one Shillings and six pence which to
the said Thomas in the same Court were adjudged for his Damages which he
sustained by Occasion of the Detention of that Debt AND WHEREAS by a Writ of
Fiere Facias of the sd. King Issued out of the Court of Common Pleas, afsd.
at Carlisle afsd. Tested the twenty third day of April in the Year afsd.
being the Year of our Lord one thousand seven hundred and seventy four and
to Ephraim Blaine Esquire late high Sheriff of the County afsd. directed He
was commanded that of the Goods and Chattles Lands and Tenements of the
aforesaid Benjamin Chambers he should cause to be made the Debt and Damages
aforesaid and that he should have that Money before the Justices aforesaid
at Carlisle aforesaid the nineteenth day of July next after the Test of the
afsd. in Part recited Writ to render to the afsd. Thomas of his Debt and
Damages afsd. and that Writ & At which Day he the said Sheriff returned that
by Virtue of the Writ afsd. to him Directed of the Lands and Tenements of
the afsd. Benjamin Chambers in his Bailiwick he had seized and taken in
Execution a certain Tract of Land / the said Benjamin having no Goods and
Chattles in his Bailiwick whereof he could cause to be made the Debt and
Damages afsd. Situate lying and being in Peters Township in the County afsd.
adjoining a Place called Loriby's Gap Containing one hundred and fifty four
Acres be the same more or less which remained in his Hands unsold for want
of Buyers as by the said in part recited Writ and the Return of the sd. late
Sherif thereon Indorsed remaining amongst the files & Records of the
Proceedings of the same Court at the Prothonitary's Office at Carlisle afsd.
may appear. AND WHEREAS afterwards by a Writ of Venditione Exponas of the
sd. King Issued out of the Court of Common Pleas afsd. at Carlisle afsd.
Tested the twenty sixth Day of January in the Sixteenth Year of the Reign
afsd. and to me the said Sherif directed, I was commanded that of the Lands
& Tenements of the afsd. Benjamin Chambers which Ephraim Blaine Esquire my
Predecessor had taken and which then remained unsold I should Expose to Sale
and that the Money thereof I should have before the Justices afsd. at
Carlisle afsd. the twenty third Day of April next after the Test of the said
last in part recited Writ to render to the afsd. Thomas of his Debt and
Damages afsd. and that Writ & At which Day I the sd. Sherif appointed
returned that by Virtue of the Writ afsd. on the twenty fourth Day of April
last past I exposed the afsd. Tract of Land to Sale by Publick Vendue at the
Dwelling House of James Pollock in Carlisle afsd Tavernkeeper / after
publick Notice given as is directed in and by an Act of the General Assembly
of this Province, made in the fourth Year of the Reign of her late Majesty
Queen Anne, instituted(?) and Act for taking Lands in Execution, for payment
of Debts and the same sold to Samuel Findlay of Peters Township in the
County afsd. Shopkeeper(?) / he being the highest bidder / for the Sum of
one hundred and fifty two pounds lawful Money of Pennsylvania which Money I
had ready before the Justices afsd. at Carlisle afsd. the twenty third Day
of April last past to under to the afsd. Thomas in Part (?) his Debt and
Damages afsd. as by the same Writ I commanded As by the sd. last in part
recited Writ and my return theron Indorsed remaining amongst the Files under
(?) Records of the Proceedings of the said Court may appear. NOW KNOW YE
that I the afsd. Robert Semple in consideration of the afsd. Sum of one
hundred and fifty one Pounds to me in Hand paid by the afsd. Samuel Findlay
before the Sealing and Delivery of these Presents the Receipt whereof is
hereby acknowledged HAVE Bargained, Sold, and Delivered and (?) the
Direction of the afsd. last in fact recited Writ. and by Force and Virtue
thereof & of the Land and Constitutions of this Province in such case made
and provided Do by these Presents Bargain, Sell, and Deliver unto the afsd.
Samuel Findlay and to his Heirs and Assigns All that the afsd. Tract of Land
/ which is bounded and described as follows that is to say BEGINNING at a
marked White Oak in Loriby's Gap thence by Lines of marked Trees South
twenty five Degrees East thirty eight Perches to a marked Chesnut Oak North
eighty five Degrees East twenty eight Perches to a marked white Oak North
seventy eight Degrees East sixty four Perches to a marked white Oak, North
sixty eight Degrees East seventy two Perches to a marked Spanish Oak North
thirty Degrees East fifty five Perches to a marked Black Oak North sixty
Degrees East fifty five perches to a marked Dogwood North thirty Degrees
East eighty Perches to a marked White Oak North thirty Perches to a marked
Walnut North seventy Degrees East eighty Perches to a marked Gum South
thirty Degrees West one hundred and forty perches to a marked Poplar and
South fifty eight Degrees West one hundred and seventy Perches to the place
of Beginning / Containing one hundred and fifty three Acres and one hundred
and fifty nine Perches and the Allowance of Six Acres p Cent. for Roads and
Highways with all and Singular the Woods Under-Woods Timber and Trees Ways
Waters Water-courses, Priviledges, Rights, Members, Hereditaments and
Appurtenances whatsoever to the same belonging or in any wise Appertaining
and Lying and being within the bounds & limits thereof and the Reversions
Remainders Rents Issues and Profits thereof and also all the Estate, Right,
Title, Interest, Property, Claim and Demand whatsoever of him the afsd.
Benjamin Chambers of in and to the same and every part and parcel thereof
with the Appurtenances, TO HAVE AND TO HOLD the aforesaid Tract of Land
hereby granted and mentioned or intended so to be and every Part and Parcell
thereof with the Appurtenances unto the aforesaid Samuel FIndlay his Heirs
and Assigns to the only proper use and Behoof of the afsd. Samuel Findlay
his Heirs and Assigns for ever according to the Form Four(?) and Effect of
the Acts of the General Assembly of this Province in such case made and
provided SUBJECT to the payment of the Purchase Money Interest Quit-Rents
and other Reservations now due and hereafter to become due to the Honourable
the Proprietaries of the Province of Pennsylvania their Heirs and Successors
IN WITNESS where of I have hereunto set my Hand and affixed my Seal of
Office at Carlisle aforesaid the twenty first day of July in the Sixteenth
Year of the Reign afsd. and in the Year of our Lord one thousand seven
hundred and seventy six.

one hundred and fifty one Pounds in full of the Consideration in the
foregoing Deed mentioned.

Cumberland County. This twenty second day of January Anno Domini 1778 Came
the within named Robert Semple Esquire late high Sheriff of Cumberland
County into open Court of Common Pleas held at Carlisle for the aforesaid
County & acknowledged the within Deed Poll to be his Act and Deed and
Desired as such the same may be Recorded IN TESTIMONY whereof I have
hereunto set my Hand and affixed the Seal of the County afsd. the Day and
Year aforesaid.
