TO ALL PEOPLE to whom these Presents Shall Come Robert Semple Esquire High
Sherriff of Cumberland County SENDETH GREETING WHEREAS by Virtue of a Write
of Our Sovereign Lord the King That now is TESTED at Carlisle the Twenty
Eight day of October in the Tenth year of our Reign. And to David Hoge
Esquire late Sherriff of Said County directed it was Commanded the said
Sherriff that of the Goods and Chattles, Lands and Tenements, of Benjamin
Chambers late of the sd. County Yeoman, Otherwise Called Benjamin Chambers
of the Province of Pennsylvania and County of Cumberland in his Bailiwick he
Should Cause to be made and Surveyed as well a Certain Debt of Ninety Eight
Pounds Eight Shillings and four Pence Lawful Money of Pennsylvania, which
Francis Campbell in the County Court of Common Pleas before the Justices of
our Lord the King at Carlisle Lately recovered Against him as Twenty three
Shillings and Seven Pence which to the said Francis Campbell in the Same
Court were adjudged for his Damag's which he Sustained by Occasion of the
Detention of the Debt whereof the said Benjamin Chambers is Convict And that
he the said Sherriff Should have that Money before the Justices of the said
Lord the King at Carlisle at the County Court of Common Pleas there to be
held the Twenty third day of January did Return to their Justices of the
said Lord the King at Carlisle aforesaid that by Virtue of the Writ to him
Directed he had Seized and taken in Execution a Certain Plantation and Tract
of Land, Situate Lying and being in Peter's Township in the County of
Cumberland with the Appurtenances the Property of the Said Benjamin Chambers
which Remained in his Hand unsold for want of Buyers so that he Could not
have the Money in the said Writ Mentioned at the day and Place in the said
Writ Specified as therein he was Commanded and that the rest of the
Execution of that Writ appeared in a Certain Schedule or Inquisition thereto
Annexed, by which Inquisition it was found that the Rents, Issues, and
Profits of the Premisses were not of a Clear Yearly Value Beyond all
Reprizes Sufficient within the Term of Seven Years to Satisfy the Debt and
Damages in the said Writ Mentioned THEREFORE by Virtue of a Certain Writ of
our Sovereign Lord the King of Vinditioni Exponas, TESTED at Carlisle the
Twenty third day of July in the Fourteenth Year of our Reign it was
Commanded Ephraim Blaine Esqr. late high Sherriff for said County that the
Goods and Chattles, Lands and Tenements of the said Benjamin Chambers which
were taken & Remained Unsold for want of Buyers he Should Expose to Sale and
have the Money Before the Justices of the Said Lord the King at Carlisle at
the County Court of Common Pleas there to be held the Eighteenth day of
October then Next to Render to the said Francis Campbell for his Debt and
Damages Aforesaid as in and by the Records and Proceedings of the said Court
Reference being thereto had may more fully Appear, and WHEREAS the Said
Ephraim Blaine Esquire Sherriff having given due and legal Notice of the
Time and Place of the Sale of the said Plantation and Tract of Land with the
Appurtenances at least Ten days before the Sale of the Same According to the
Directions of the Act of General Assembley of this Province in that Case
Made and Provided did Expose the Same to Publick Sale on the Nineteenth Day
of October in the Year of our Lord One Thousand Seven Hundred and Seventy
four, at which Sale Samuel Finley of the County aforesaid, Being the Highest
and best Bidder the aforesaid Plantation and Tract of Land with the
Appurtenances for the Consideration of sum of Five Hundred and Forty one
Pounds Lawful Money of Pennsylvania did Buy & Purchase. NOW KNOW YE that the
said Robert Semple Esquire high Sherriff of Cumberland aforesaid (The time
Limitted by Law for the Said Ephraim Blaine to hold the Said office being
Expended before any Deed was Made to the Said Purchaser) By Virtue of his
Said Office of Sherriff as is Pursuance of the Act of General Assembly of
this Province in that Case made and Provided, And also in Consideration of
the aforesaid Sum of Five Hundred and Forty One Pounds Lawful Money
aforesaid to him in Hand Paid by the Said Samuel Finley the Receipt and
Payment whereof is Hereby Acknowledged, Hath Bargained, Sold, Aliened,
Released and Confirmed unto the said Samuel Finley and to his Heirs and
Assigns all the Above Mentioned Plantation and Tract of Land Situate lying
and being in Peter's Township in the County aforesaid Bounded and Described
as follows (viz) Beginning at a Hickory on the Bank of Conichocheque Creek
thence by James Wilkins Land North Fifty degrees East Ninety three Perches
to a Hickory, Thence by James McClellands Land South Sixty Degrees East
Ninety Perches to a Post Thence South Sixty Seven Degrees East one Hundred
and Sixty Perches to a Hickory Thence by Land of Oliver Wallace South Twenty
four Degrees West Two Hundred and One Perches to a white Oak, Thence by
Robert Culbertson's Land North fifty one Degrees West two Hundred and Thirty
Perches to a White Oak, Thence South Sixty Eight Degrees West Forty four
Perches to an Elm, Thence by Robert McFarland's Land North Sixty Degrees
East Fifty Perches to a White Oak, Thence up the aforesaid Creek Fifty Nine
Perches to the Place of Beginning, Containing Two Hundred and Sixty four
Acres & the usual Allowance of Six Acres p Cent, for Roads, Together with
all and Singular the Buildings and Improvements, Rights, Members,
Priviledges, Advantages, Hereditaments and Premisses, with the Appurtenances
Whatsoever thereunto Belonging or in any wise Appertaining and the
Reversions and Remainders, Rents, Issues and Profits thereof, and all the
Estate, Right, Title, Interest, Property Claim and Demand Whatsoever both at
Law and in Equity of him the Said Benjamin Chambers of in and to the Same
and Every Part thereof TO HAVE AND TO HOLD the said Plantation and Tract of
Land with the Appurtenances unto the Said Samuel Finley his Heirs and
Assigns to the Only Proper Use Benefit and Behoof of the Said Samuel Finley
his Heirs and Assigns forever, IN WITNESS whereof the Said Robert Semple
Esquire high for Said County hath hereto set his Hand and Seal this Twenty
fifth day of January
