TO ALL PEOPLE To whom these presents shall come John Holmes Esqr. high
Sherriff of the County of Cumberland in the Province of Pennsylvania Sendeth
GREETING Whereas by Virtue of a Writ of Fieri Tricias(?) of our Lord the
King tested at Carlisle the Twenty fifth day of July in the Seventh Year of
the Reign of our Lord the King and to the Same Sheriff directed Commanding
him that of the Goods and Chattles Land & Tenements of Thomas Finley of
County aforesaid yeoman in said Sherriffs Bailiwick he should Cause to be
made & Survyed as well a Certain Debt of Two hundred pounds Lawful money of
Pennsylvania pleas before the Justice of our Lord the King at Carlisle in
County aforesaid Recovered Against him as Seventy nine Shillings & Eleven
pence of the Like Money which to the said Henry Shadron in our June Court
were Adjudged for his Damages which he Sustained by occation of the
Detention of that Debt whereof the said Thomas Finley is Convicted and that
the said Sheriff should have the said Reccited Writ & Money before the
Justices of our said Lord the King at Carlisle aforesaid at the County Court
of Common pleas there to be held the twentyith Day of October then next
Coming to Render to the said H. Shadron for this Debt & Damages aforesaid
and whereas the said Sheriff on the same twentieth day of October did action
to the said Justices at Carlisle afforesaid that by Virtue of said writ to
him Directed he had Seized & taken in Execution a Certain Plantation or
tract of Land Situated & being in Westpennsborough Township & County
Aforesaid with all the Appurtenances thereunto Belonging being the property
of the said Thos. Finley which Remained in his hand unsold for want of
Buyers so that he Could not have the money in said Write Mentioned at the
day & place In the same Writ specified as he was Commanded & that the rest
of the Execution of the said Writ appeared in a Certain Schedule of
Inquisition hereunto annexed by which Inquisition Consisting of Twelve Free
& lawful men of said County it was found that the Rents Issues & Profits of
the said tract of Land Messuage(?) & Premisses were not of a Clear yearly
Value beyond the Reprizes Sufficient within the term of Seven years to
Satisfy the Debt & Damages in the said Writ mentioned Therefore by Virtue of
a Writ of Vendition Exponas aforesaid the King tested at Carlisle aforesaid
the Twenty third day of April in the year 1768 it was Commanded the above
named Sheriff that of the goods & Chattles Land & Tenements of the said
Thomas Finley which by his was afforesaid and Seized & Taken in Execution &
Remained in his hands unsold for want of Buyers he Should Expose to Sale &
have the money before the Justices of our Lord the King at Carlisle
aforesaid at the Court of Common pleas there to be held the nineteenth day
of July then Next to Render to the said Henry Shadron for his Debt & Damages
aforesaid as in and by the proceedings & Records of the said Court Referance
being thereunto had may more fully appear & WHEREAS the said Sheriff having
given due & Legal notice of the time & place of the Sale of said Messuage or
tract of Land with all the Appurtenances at Least ten days before the day of
Sale did Expose the same to Publick Sale the twenty first day of this
present Month at which sale James Weakley Junr. of Westpennsborrough
township & County aforesaid being the highest & best bidder the aforesaid
Messuage Premisses & tract of Land with the Appurtenances for the
Consideration or sum of thirty three pounds lawful money of Pennsylvania did
buy and Purchase NOW KNOW YE that the said John Holmes high Sheriff of the
County aforesaid as well by Virtue of the above mentioned Writs & his office
of Sheriff & in Pursuance of the Directions of the act of the General
Assembly of this Province in that Case made & Provided as for & in the said
sum of thirty three pounds Lawful money aforesaid to him in hand by James
Weakley at or before the Execution hereof the Receipt & Payment whereof is
hereby Acknowledged HATH Granted Bargained Sold Aliened Released & Confirmed
& by these presents DOTH Grant Bargain Sell Release and Confirm unto the
said James Weakley and to his heirs and Assigns all the above Mentioned
Messuage Premisses & Tract of Land which Land is Situated in
Westpennsborough township Lying on both Sides of Yellow breeches Creek in
County Aforesaid & Bounded as follows Viz. by land belonging to James
Weakley Senr on the East by Dos (ditto?) Land on the South by Land of Samuel
Brice on the West Containing one hundred & twenty Acres with Allowance at 6
p(?) Cent, be the same more or Less together with all & Singular the
Buildings & Erection Mills & Millseats(?) thereon Water Water Courses Timber
fences Rights Members Priviledge Advantages Hereditaments and Premisses with
the Appurtenances whatsoever thereunto belonging or in any wise Appertaining
& Reversions & Remainders Rents Issues & Profits therof & all the Estate
Right Title Interest Property Claim & Demand Whatsoever both at Law & in
Equity of him the said Thomas Finley his heirs Executors Admr. & Assigns of
in & for the same & every part and Parcell thereof TO HAVE AND TO HOLD the
said Described Messuage & tract of Land with the Appurtenances unto the said
James Weakley his heirs Exrs. Admr. & Assigns to the only proper use Behoof
& Benefit of the said James Weakley and his heirs Exrs. Admrs. the said
Premisses & also Subject to the Purchase money & quit Rents Due & to become
due to the Chief Lord or Lords of the fee thereof or the same IN WITNESS
whereof the said John Holmes Sheriff hath hereunto set his hand & Seal this
Sixteenth day of August Anno Domini MDCCLXVIII & in the Eighth year of the
Reign of our Sovereign Lord George the third King of Great Britain (?)
