Cumberland County .. October Term 1776
Thomas Findley late of Cumberland County Yeoman Otherwise Called Thomas
Finley of Cumberland County and province of Pennsylvnia was summonded to
answer Stephen Duncan of a plea that he render him Forty seven Pounds nine
Shillings lawfull Money of Pennsylvania which to him he owes & unjustly
Detains vc And whereupon the said Stephen his own PPP on faith that whereas
the said Thomas the Twenty first day of November In the year of our Lord One
thousand Seven hundred & Sixty Six at Carlisle in the County aforsd By his
certain Bill Obligation which the said Stephen with the ??? of the said
Thomas ??? hire into Court brings the Date whereof is the same Day & year
afsd did acknowledge himself to be Indebted to the said Stephen in the Sum
of Twenty Three Pounds fourteen shillings & Six pence to be paid to the said
Stephen at or upon the First day of December then next after the Date of
siad Bill to such Payment will & Truly to be made the said Thomas did lend
himself in the afsd sum of Forty Seven Pounds nine shillings and the said
Stephen in ??? faith that the afsd Thomas did not pay him the said Stephen
the afsd Sum of Twenty three pounds fourteen Shillings & Six Pence on the
same First day of December which to him on the same Day he Ought to have
paid According the form & effect of the Bill afsd By which ??? hath Answered
to the said Stephen to require & have of the said Thomas the afsd Sum of
forty Seven Pounds nine Shillings Nevertheless the said Thomas tho Often
required the afsd Sum of forty Seven pounds nine Shilllings to the said
Stephen hath not paid but the same to him to pay hath refused & Still doth
refuse To the Damage of the said Stephen Twenty Pound & therefore he brings
suit vc Stephen Duncan in PPPion
