Will of Thomas Kendall - April 13, 1795
A will in the name of God Amen the thirtieth day of April and year of our Lord one thousand seven hundred and ninety five—I Thomas Kendall of Fayette County and state of Pennsylvania I being in perfect health of body and of perfect mind and memory thanks bee to the almighty God. Therefore calling to mind the mortality of my body and nerig it is appointed for all men once to die I do make and ordaiy this my Last will and testament that is to say principally. I recommend my soul into the hand of Almighty God that gave it and for my body I recomment it to the dust from whence it came to bee buried in a Chrisan form and deacent manner. In the first place it is my will and desire that my fee debts and funeral charges may be paid, I promis I give and bequeath unto my well beloved wife Margaret the dwelling house where I now live in and the one half of the orchert when she chuesisit during her widowhood in the second place. I give and bequeath unto my son John the tract of land when I were liv on. By giving his mother difficult mantainence out of the same. During her widowhood with out her labour separate and besides the above mentioned downy and at his deise the said land to fall to his son Thomas and if his son Thomas should dye having no heir the above land is to fall into my sons Samuel hands and at his deceis it to fall to his eldest heir and if he should bye having no heir it is to fall into my daughter Nancy’s hands and at her decius it to fall to her eldest heir and that forever thirdly I bequeath unto my daughter Nancy that track of land wheron David Spear now lives on during her life and at her decis the said land to fall to her eldest son and if she dyes having no son then the land is to be equally divided between her two brothers John & Samuel and at their deceis is to fall to their eldest mail heirs fourthly I do bequeath unto my son Samuel that track of land where widow Lucas now lives. Or during his life and at his decise it to fall to his eldest mail heir and if he dyes having no mail heir they the one half is to fall to his brother John and the other half to his sister Nancy during her living single and if she marrys and has a mail heir there at her deacis it is to fall to him and if she dyes having no mail heir then the whole is to fall into John’s hands and at his deceis it is to fall into his dist sons hands forever fifthly as teaching the movabels I bequeath unto my daughter Nancy one hans Bridle and which is now called hers, Likewise one cow and fore head of sheep and one feather beed & furniture also I do bequeath of the movabls to my son Samuel one horse that is now called his with a bridle and saddle and give cow and for head of sheep and one feather beed and all the rest of the goods and Chattles to bee left in my wife Margretts hands and to be at her disposal likewise it my desire that my son Samuel should be sufficiently scooled out of the property that is left in my wifes hands my last will and testament is that Jacob Beason senior Ephenine Douglas and Samuel Kendall shall bee my rail executors to settle and confirm my hoal estate. In witness when of I have hereunto set my hand and seal the day and date within written .

Fayette County sst March 2, 1804
The second day of March an Domiui 1804. Before me Register for the Probate of wills and granting letters of Administration in and for said bounty personally came James Kendall the first subscribing witness to the foregiving writing purporting to be the last will and Testament of Thomas Kendall are of Union Township dececesed and on his soleum oath declare that he saw the Testator execute the same in the usal form. Acknowledging it to be his last will and Testament that at the time of doing the same he was in his right mind to the best of his knowledge and that no undue influence had been used or later will made by him to his knowledge or belief-Given under my hand and seal of the Registers Office the same day.

I Alexander MCleau Register for the Probate of wills and granting letters of Administration in and for the county of Fayette in the Commonwealth of Pennsylvania aforesaid do hereby depute nominate authorize and appoint John Ellison Esqr of Manchester Adams County in the state of “Ohio” to cause John Kendall and Samuel Kendall the latter signing witnesses to the forgoing writing surporting to be the Last will and Testament of Thomas Kendall lah of Union Township Fayette County and Commonwealth aforesaid to come before him and having executed there or either of them on their or either of their oaths oaths, affirmation or affirmations (as the case may be) to certify the same to me under the hand and usal seal of the said John Ellison agreeably to the form before inserted or of any other form of like support the Testimony whereof I have hereto set my hand and seal of the Registers Office the Eighteenth day of April in the year of Our Lord One thousand and four

I Alexander McClean register for the probate of wills and wauting letters of Administration in and for said county do approve and accept to certificate of John Ellison as part of the probate of the last will and Testament of Thomas Kendall late of the county of Fayette deceased. In testimony whenof I have hereto set my hand and caused the seal of the registers office to be confirmed the 13th day of June 1804
