Coal Operator,
Sportsman Dies

Rev. Thomas Charlesworth, pastor of the Cochran Memorial church, will be in charge. Burial will be in Cochran Memorial cemetery. Mr. Tarr, a native of Fayette county and one of its best known citizens, has been in failing health for several weeks. Throughout his life he had been interested in sports, and in 1921 brought to Fayette county the leading semi-pro team of Western Pennsylvania. The team, known as Yough Valley Independents, was made up of some of the leading stars.

From the ranks, several of his younger players graduated into organized baseball. The foremost of his proteges was Eddie Wells, who on completion of his college course at Bethany, joined the Detroit Tigers. Wells later was traded to the St. Louis Browns. Other well known figures in sports who obtained their start under Mr. Tarr, were Harry “Timble” Randolph, who received a trial with Detroit and later played in the Southern Association, “Ted” Pritchard of Flint who, on leaving the ranks of the Y. V. I., joined the professional ranks in the Pennsylvania-New York league, serving as a hurler for the Williamsport club. Prichard is now director of playgrounds for the city of Flint. Another boy, who obtained his start with Tarr’s club is George Rorak, head football coach at Washington and Jefferson college.

Mr. Tarr retired from baseball at the close of 1921 season and for several years was manager of the Whistle bottling works at Connellsville. Not until the introduction of soft ball did he return as an active figure in sports. He then organized a soft ball club for the children in his community and was also instigator of starting soft ball leagues in that area. He remained active in this past-time until his health became such that he could no longer look after its interests. During the last several years, aside from serving as tax collector in Lower Tyrone township, Mr. Tarr had lived a quiet and retired life with his wife Lissa at their home on the Sarah B. Cochran estate. Mr. Tarr also served as president of the Yough Coal Company at Dawson. He was a member of the Phillip Cochran Memorial church of Dawson and was active in church affairs. Iley TATE ( -1932)

REFUSING BAIL,
TATE BROTHERS
HELD TO COURT

Formal Information On
Murder Charge Not Yet
Made By Jack Hann

HABEAS CORPUS HEARING

Judge Morrow Renders His
Decision After Hearing
Testimony In Court

Judge S. John Morrow this afternoon remanded George Tate, 18 and his two brothers Sam 14 and John 21 to the Fayette county jail to answer charges of murder in the killing of their father Iley Tate on September 14 last. Attorney Edward D. Brown bitterly fought for the release of john Tate in bail but to no avail. Formal informations have not yet been lodged against the boys but will this afternoon before Justice of the Peace William Ruble, of Fairchance and a hearing will probably be conducted at once. District Attorney Melvin Snyder of Preston county, W. Va., with an assistant K.L.G. Street were in court but made no statements. They were here to get facts for possible future charges in their state where the alleged conspiracy to kill the father had been hatched.

John Not At Scene

All three are held on murder charges growing out of the brutal slaying of their father, Iley Tate, “hard-boiled” mountaineer. George, according to the police, did the actual slaying. Sam was with him and helped move the body. John was not at the scene when the slaying occurred, but is alleged to have conspired in the family death plot. Testimony was taken before Judge Morrow, and County Detective Jack A. Hann told of the finding of the body and read portions of the confessions made by the defendants to himself and State Trooper George Naughton. The testimony introduced at today’s hearing was much less detailed than that given at the coroner’s inquest yesterday afternoon. Attorney Brown told Judge Morrow he had no facts in the case as he had never been permitted to see any of his clients until they were brought into court. County Detective Hann said George had been held in the county jail and Sam and John had been confined in the city police station on orders of Coroner Baltz who had instructed the county detective to hold them incommunicado until after the inquest yesterday afternoon.

Disclosures Coming

Both the commonwealth and the defense have promised many startling disclosures, none of which have been published, when the case actually comes to trial in December. Brown says that under no circumstances will his clients enter a plea of guilty, despite the fact that all have allegedly made signed confessions. District Attorney Newell says the state has worked up an open and shut case against the boys and he will be fully prepared to present his case impartially to the court and jury. “The task is most unpleasant, but it is a duty of my office which I have sworn to perform,” and I can not side step that duty,” said Newell, following the hearing.

Bouncing Baby Boy Born
Just Before Daybreak To
Lone Widow Of Iley Tate
Husky Youngster, Twelfth
Child In Family, Born
Near Bruceton Mills

While Iley Tate, colorful, rugged, iron-handed man of the hills sleeps the peaceful slumber of death in a little Fairchance cemetery, his spirit doubtless hovers over the isolated mountain cabin where today his widow, Mrs. Nettie Tate lay rejoicing over the blessed event of a bouncing baby son. The lively, healthy, kicking little fellow happily wailed his way into the world at exactly 5:15 a.m., and in first opening his eyes, blinked at the lamp light suffusing the crude little cabin room near Bruceton, and then wrinkled his face into an infantile smile as he saw Dr. S. R. White, the attending physician, standing nearby. Dorothy, nine-year-old daughter of Mrs. Tate, was the first of the children to hear the glad tidings, and in excited ecstacy [ecstasy] awakened her brothers and sisters to tell them “it’s a baby brother.”

Weighs 11 Pounds

The bouncing youngster is said to have tipped the scales at 11 pounds and is a fine specimen of infanthood, Dr. White declared. The new boy is the twelfth child born to Mrs. Tate to her late husband, Iley, ambushed and allegedly murdered two weeks ago by his three sons, and who was purportedly the father of some 25 children by former marriages. The Tate household today was joyously endeavoring to decide upon a name for the boy, while neighbors were tiptoeing into the maternity chamber to view “Iley’s new son.” John, George and Sam, three brothers of the baby, are in the Fayette county jail awaiting trial on charges of murder. They were informed of their latest brother by Attorney E. D. Brown who will fight for their acquittal in court.

GEORGE TATE GETS LIFE SENTENCE
BROTHER SAM TO
HUNTINGDON, THE
COURT DECREES

Evidence Showed First De-
Cree, Judge Morrow States
When Giving Sentence

JOHN PUT UNDER PAROLE

Third Brother Had No part
In Actual Crime and Was
Long Time in Jail

George Tate, the “Black Sheep” of the Tate family was sentenced by Judge Morrow Friday morning to life imprisonment in the Western penitentiary for the murder of his 68 year old father, Isley Tate, last Sept. 14. George, together with his 15-year- old brother, Sam, had entered pleas of guilty to the murder, it devolving upon the court to determine the degree of guilt. The sentence of the younger brother was that he be committed to the Pennsylvania Industrial school at Huntingdon to be kept and treated as the law directs. The refusal of the two youthful defendants to take the witness stand in their own behalf made the determination of the degree more difficult for Judge Morrow. Had the defendants testified, the various phases of the killing plot could have been brought out by District Attorney Wade k. Newell. Apparently unmoved in any way, the two mountain boys faced the court, accompanied by their attorneys, Captain E. J. McDaniel and E. D. Brown. Neither had anything to offer when asked by the judge if they had anything to say before sentence was pronounced upon them. In a few brief remarks, Judge Morrow spoke of the extensive testimony he had heard on the case, referring to the opinion he had prepared upon it. He then called the defendants in front of him and pronounced the sentence upon them.

Morrow Reviews Evidence

George Tate indicated that he had hoped for a sentence to the Fayette county jail “where mom can come to see me,” but was apparently satisfied with the decree of the court as was the youthful Sam. In his opinion, Judge Morrow, in reviewing the case stated that “As we view the evidence, it admits of no other conclusion than that George is guilty of wilful, deliberate and premeditated killing of his father by lying in wait for him and shooting him.” Ruling that Sam had guilty knowledge of George’s plan to kill the father, he nevertheless said that “Viewing the statements and other testimony as a whole, we would rather believe that the boy could not bear to see his old father shot down.” The youth of the defendant was also probably taken into consideration in the sentence to Huntingdon. Among the mass of testimony offered following the pleas of guilty by the two boys, there was much bearing on the alleged brutality of the 68 year mountaineer. Isley Tate was said to have ruled his family in the most harsh and cruel manner. He was said to have had five wives during the course of his life, part by legal marriage and others through the common law process.

Favorable Sentiment Aroused

Much sentiment had been aroused in favor of the two boys through the testimony which revealed the treatment of the family in general and the boys in particular. There were eleven in the Tate family altogether at the time Tate was killed, a 12th child having been born after the killing. Much interest was manifested in the probable disposition of the case against John Tate, the oldest son in the family, who had at first been implicated in the crime. John was exonerated on the actual murder charge, but having admitted receiving a portion of the $200 taken from the pockets of the old mountaineer after the shooting, was held on a charge of receiving stolen goods. In pronouncing sentence on this defendant, Judge Morrow took into consideration the fact that he had been in the county jail since the 16th day of last September. He therefore placed John on probation for a period of three years, with the costs of the case to be paid by him within a period of four months. The judge ruled that the defendant would, during the time of probation, be permitted to work upon the home farm, thus enabling him to pay not only the costs, but an additional $500 which amount is to be paid in monthly installments. This sentence appeared to be thoroughly satisfactory to John Tate, who was of the opinion that he would be able, through the operation of the farm, to meet the required payments as scheduled.

John L. TAYLOR ( -1863)

Died at the residence of his father, in Jefferson Tp., Fayette Co., Pa., on the 24th of Feb. '63, John L. Taylor, son of Alexander Taylor, in the 23d year of his age. The deceased was a member of Capt. C. L. Couner's company from Brownsville, Fayette Co. He joined the army on the 1st day of May, '61, and continued to perform the duties of a soldier patriot to the time of his hard fought battles before Richmond, in which he participated for two days, when his strength failed him in consequence of having contracted a disease of the lungs from exposure on the Peninsula, he was honorably discharged on the 8th day of July, 1862, and came home to die among his friends. It is no doubt a great consolation to his bereaved father that he was permitted to watch over him and administer to his wants during his long and painful illness. He was an ardent admirer of the military abilities of General McClellan, and in conversation with the writer of this article, he has often said he joined the army to vindicate the honor of the Stars and Stripes, and to restore the Union as it was under the constitution as it is—and not for the purpose of emancipating the slaves, and had hoped to see the Stars and Stripes waving in triumph over a united people, but in this he was doomed to be sadly disappointed. He was perfectly resigned to the will of his Heavenly Father, and at his own request he was enshrouded in the Glorious Stars and Stripes for his winding sheet. Peace be to his memory.
