From Mr. Phillip Maguire’s house this day 22nd
October 1844.
I, Phillip Maguire Senior, do make and publish this
my last will and testament hereby revoking and making void all foreign
will(s) by me at any time heretofore made and first I direct that my body
be decently interred in the burying ground of the catholic church
according to the rites and ceremonies of the said church, and that my
funeral be conducted in a manner corresponding to my estate and situation
of life. Phillip

I resign the clothes belonging to my wife, Catherine
Maguire, to my daughter, Barbara Winger, left to her by her father,
Phillip Maguire Senior. I
resign by will the mare and three year old colt to my son, Thomas Maguire.

I resign by will to Sally Maguire, the wife of my son
William Maguire, the yearling colt. Phillip

I resign by will one hundred acres of land situated
in Beaver Township for the purpose of building a catholic church in the
burial ground existing near my dwelling house and in the supposition that
the church would not be built, my will is that 50 acres of the same land
be given to John Maguire, son of James Macguire.

And the other 50 acres of the same land will be given
to Phillip Maguire, son of Francis Maguire; if said church would not be

I leave by will to Bernard Maguire, son of Thomas
Maguire, the clock and case and cupboard.

I leave by will to my son, James Maguire, and to my
son, Phillip Maguire, the lot containing sixty acres of land; providing
that James Maguire pays to his brother, Phillip Maguire, fifty dollars in
cash; and if he does not pay the fifty dollars in cash; the land is to
Phillip Maguire the payment to be made by James Maguire to his brother,
Phillip Maguire, in the inside of one year.
If not the land is to Phillip Maguire.

I leave one cow to my son, Thomas Maguire, and one
cow to William Maguire; of these two cows, Thomas Maguire will choose as
he pleases. Phillip

Left by me to Catherine Maguire, daughter of James
Maguire, the bureau.
In the supposition that the church would not be
built, James Maguire, son of James Maguire, will have the 50 acres of
land. And if the church goes
on, Phillip Maguire is to give back fifty dollars to James Maguire. And Phillip Maguire is to hold the sixty acres of land.

meats; and to my son, Thomas Maguire, I leave the old steer. Phillip

Have to this my will written on one sheet of
paper, set my hand and seal this 22nd day of October in
the year of our Lord one thousand eight and forty-four.

Personally came before me the subscribed Registrar in
and for said County, Thomas Feagan and Michael Mitchel two of the
subscribing witnesses to the within instrument purporting to be the last
will and testament of Phillip McGuire, Sr., late of Summit township
dec’d and on their solemn oathes depose and say that they were present
and saw the testator make his mark thereto and that Feagan signed the same
as a witness in the presence of the testator and also wrote the name of
Mitchel to the same as a witness in the presence of said Mitchel and said
dec’d. He declaring it to
be his last will and testament at which time we believe he was of sound
disposing mind and memory to the best of our judgements and beliefs.
