Last Will and Testament of Philip Kline

1855: Tulpehocken Township, Berks County, PA

In the Name of God, Amen, I Philip Kline of Tulpehocken Twp., Berks Co., and State of Pennsylvania, Yeoman, being in perfect health of body and of sound mind memory and understanding , but considering the uncertainty of this transitory life, do make and Publish this My last will and testament, in manner and form following, to wit:  First, it is my will, and I do order, that all My Just debts and funeral expences be duly paid and Satisfied as soon as conveniently can be after My decease,

Item, I give and bequeath unto my dear wife Catharine So much of my household and Kitchen furniture, or utensils, as she may choose to Keep for her own use.

 

Item, I give and Bequeath unto my Said wife, my one Story Brick dwelling house and the three lots of Ground, Situate in Reohrersburg, township and County aforesaid, now in the tenure of my son Benjamin, during her natural life, and after her decease the same to be sold at Public Vendue or out cry, by my hereinafter named executors or the Survivor of them, and the proceeds arising therefrom after deducting costs & expences to be divided among my seven children share and share alike.

 

Item I give and bequeath unto my Said wife five hundred dollars, which Shall be paid unto her, by my hereinafter named Executors or the Survivor of them, out of the first money in their hands of the said Estate,

And further I do order and direct that my said hereinafter named Executors, Shall put out at interest well Secured, one thousand dollars, for the use of my said wife, and the Interest of the said one thousand dollars, shall be anually paid to my Said wife during her natural life, and after her decease, the Principal to be divided equally among my seven children, and as touching all the rest, residue and remainder of my Estate, real and personal, I do order and direct, that my Executors hereinafter named or the Survivor of them, Shall, as soon as conveniently may be after my decease, Sell and dispose of the same, to such person or persons and for such price or prices as may be reasonable gotten for the same, and for that purpose

I do hereby authorize and empower my said Executors, or the Survivor of them, to Sign, Seal, execute and acknowledge all Such deed or deeds of conveyances as may be requisite and necessary for the granting and assuring the same to the purchaser or purchasers thereof, in fee simple, and the monies arising therefrom, or from such Sale or Sales, to be equally divided among my seven children share and share alike,

and lastly, I nominate, constitute and appoint my son Benjamin and son in law Benjamin Klahr to be the Executors of this my will, hereby revoking all other wills, legacies, and bequests  by me heretofore made, and declaring this, and no other, to be my last will and testament, In witness whereof, I have hereunto set my hand and Seal, the twenty ninth day of July In the Year of our lord one thousand eight hundred and fifty one.
