To the honorable the judge of the Orphans' Court for the county of Berks

The petition of Peter D. Miller of the County of Berks, one of the brothers and legal representative of George D Miller late of Windsor Township Berks County deceased, respectfully showeth; that the said George D Miller died without leaving any widow or children, he having never been married; but leaving brothers and sisters to wit, Philip H. Miller (now deceased who left six children to wit Jonathan Miller, Eli Miller, Catharine Moyer wife of Daniel Moyer, Elizabeth Moyer wife of Jacob Moyer, Leah Rick wife of George Rick, and Mary Balthaser wife of George Baltser.) Peter D. Miller, Jacob Miller (now deceased leaving one child to wit, Esther Brownmiller, wife of Moses Brownmiller,) Daniel Miller, William Miller and Magdalena Degler (widow of [blank] Degler deceased). That the said decedant George D. Miller was seized in fee of and in two certain lots or pieces of ground situated in said Windsor Township Berks County bounded and described as follows to wit No 1. containing about four acres more or less adjoining lands of Charles Keller on the north, on the west by the Schulkill Canal, and on the south by land of Jeremiah Koller, and on the east by the Center Turnpike.

No 2. containing seven acres and ninety three perches more or less, bounded on the north by land of Jeremiah Koller, and on the west by the Center Turnpike, and on the south by land of Daniel Moyer, and on the east by land of the said Daniel Moyer and Samuel Stoyer. That no petition or valuation of the said decedant's estate having been made, your petitioner requests the court to be pleased to award an inquest to make partition of the premises aforesaid, to and among the representatives of the said intestate, in such manner and such proportions, as by the laws of this Commonwealth is dictated, if such partition can be made without prejudice to or spoiling the whole. But if such partition cannot be made thereof, then to value and appraise the same, and to make return of this proceedings according to law, and he will pray.
