Petition of Administrator

To the Honourable the Judges of the Orphans' Court of Berks County

The Petition of John Boltz administrator of Samuel Miller, late of Upper Tulpehocken Township, Berks County dec. respectfully states;

That said Samuel Miller died intestate in the month of May 1841 leaving a widow & one child; & seized of the following real estate; sic: One tract of improved land situate in Upper Tulpehocken Township, Berks County bounded by lands of John Berger, Daniel Moyer, John Straus & George Moyer & others; containing eighty-one acres, more or less; whereon are erected a one story log dwelling house & log barn; also seised of one tract of woodland, situate in same Township & County; bounded by lands of McCrea & Blythe Catharine Wert, Jacob Hay & others; containing eighteen acres, more or less.

The above described real estate is all the real estate of said decedent, which has come to your Petitioner's Knowledge.

The personal estate of said intestate is insufficient for the payment of his debts, as appears by the schedule, statement & inventory hereto annexed.

Your Petitioner, therefore, prays your Honours to grant him an order of sale of said real estate, for the purpose of paying the debts of said decedent.

Know all mens by these presents; that We, John Boltz & John Potteiger, both of Upper Tulpehocken Township, Berks County, & Peter Boltz of Bethel Township. Berks County, are held & firmly bound to the Commonwealth of Pennsylvania, in the sum of Three thousand Dollars, to be paid to the said Commonwealth; to which payment, will & truly to be made & done, we bind ourselves, jointly & severally, ours & each of our heirs, executors & administrators, firmly by these presents; sealed with our seals, and dated the ninth day of August A.D. 1841.

Whereas Samuel Miller, late of Upper Tulpehocken Township, Berks County, died intestate, & JohnBoltz, by due course of laws, has become his administrator; & where as the personal estate of said Samuel Miller is insufficient for the payment of his debts; & the said John Boltz, Administrator as aforesaid is about to apply to the Orphan's Court of Berks County, for an order of sale of the real estate of said deceased; Now in case the said Court grant an order of sale of said real estate, or any part thereof, then

The condition of this obligation is such; that if the above bounden John Boltz administrator as aforesaid, shall faithfully appropriate the proceeds of such sale, according to his respective duties, then this obligation to be void, or else to be & remain in full force & virtue.

Whereas my Late Husband Samuel Miller died Intestate whereby the Right of the Administration of the Estate of the said deceased did devolve upon me Ledia Miller widdow and Relict of the Said Deceased Now Know Ye that for divers Good Causes and Considerations me thereunto moving I have Released and hereby do Release all my Right and title to the Administration of the Said Estate Witness my hand and Seal this 31st day of July AD 1841

Request for Inventory of Estate

This document dated the 2nd of August Anno Domini 1841 is a type set paper requiring John Boltz, administrator for Samuel Miller deceased, to make an inventory of all goods, chattels and credits within a year of this date. It is signed by Joel Ritter and the 3 men above.

Petition of George Degler

To the Honorable the Judges of the Orphans Court of Berks County

The petition of George Degler respectfully represents,

That on the 30th day of May AD 1842 he was appointed by the Orphans Court of Berks County guardian of Melinda Miller a Minor child of Samuel Miller late of Berks County descesed. That it has become inconvient for him ? to execute the said trust that he has pled his account in the registers office at reading. And he now prays your honor to discharge him from the further execution of the trust. He further represents that the said Melinda has since his appointment intermarried with Amos Sallade of Upper Tulpehocken township in this County. All which is respectfully represented.
