To the Honorable the Judges of Orphans Court of Berks County:
The Petition of Jeremiah Hine Administrator de bonis non with the will annexed of Mary Bunn late of Amity Township Berks County, deceased, respectfully represents: That the said Mary Bunn, decd, died in or about the year 1836 having made her last will and testament dated 23rd October 1834 which was duly presented before the Register of Berks County on the First day of August 1836 and letters testamentary granted to the Executors therein named, to wit: Jeremiah Boyer, Isaac Boyer and Henry Boyer, grandsons of the said testatrix, the said Jeremiah, Isaac and Henry are since deceased, and letters testamentary de bonis non with the will annexed have been granted to your petitioner. By said will the said testatrix bequeathed an estate real and personal – except a few special legacies – to have and to hold the said estate in trust for their mother Hannah Boyer and to pay to her as she may direct, all the rents, issues & profits of the same, and after the decease of the said Hannah Boyer, and of her husband Henry Boyer, said estate was to be equally divided among the grandchildren of the said testatrix, except that Jeremiah one of the said grandchildren was to have only half as much as any other grandchild; that by said will certain privileges were granted to Julian Boyer, one of the grandchildren in said estate. Said real estate consists of two pieces or tracts of land, as follows: one piece or track situate in Exeter Township Berks County containing about 66 acres, whereon is erected a Tavern house, wherein the said Hannah Boyer now resides, one piece or tract in Amity Township in said County, bounded by lands of Samuel Weitzel, lands late of Moses Yocum, and by the Reading railroad, containing about 66 or 67 acres, whereon are erected a stone house and barn. Henry Boyer, the husband of said Hannah is since deceased, leaving the said Hannah surviving him. The said tract of land in Amity Township is getting out of repair and is so unproductive and unprofitable that it would greatly promote the interest of all the parties interested to have an immediate sale of the said tract. The parties now interested are the said Hannah Boyer who is entitled to the life estate as herein before described, Charles Henry, William Valentine and Anna Maria Boyer, children of Henry S. Boyer, deceased, who are minors and have Harrison S. Ludwig for Guardian, Julia Ann Boyer and Catharine Boyer, the only child of Jeremiah Boyer, deceased.
Your Petitioner therefore respectfully prays your Honors to grant an order authorizing the sale of the tract of land situate in Amity Township as aforesaid.
And the will pray &c
