Last Will and Testament of John Moll

Hereford 1860

In the name of God, Amen; I John Moll of the Hereford Township in the County of Berks and State of Pennsylvania, Farmer, being weak in body but of sound mind, memory and understanding and considering the uncertainty of this transitory life do make and publish this my last will and testament in the following manner to wit:

First: It is my will and I do order that all my just debts and funeral expenses be duly paid and satisfied as soon as conveniently can be after my decease.

Second: It is my will and I do order that my hereafter named Executors shall take an inventory of my personal property and shall sell my household goods and farming utensils at public sale.

Third: It is my will and I do order that my Executors shall sell all my real estate either at public or private sale, in such parts or parcels as they may deem most profitable to my estate and give title or deeds for the same as legal and valid as I myself can or could do to convey the premises in fee simple.

Fourth: It is my will and I direct that the whole of my estate shall be equally divided to and among my ten children, their heirs of legal representatives, that is to say I give and bequeath one tenth of my estate unto my son George Moll, one tenth unto my son Jacob Moll, one tenth unto my son John Moll, one tenth unto my son Christopher Moll, one tenth unto my daughter Mary late wife of Anthony Staehler decd, one tenth unto my daughter Catharine the wife of Jacob Snyder, one tenth unto my daughter Elizabeth the wife of Michael Gery, one tenth unto Nancy the wife of Peter Mensch, one tenth to my daughter Susanna the wife of Henry Hoffman, and one tenth unto my daughter Rebecca the wife of Peter C Dallman.

Fifth: I give and bequeath unto my daughter Rebecca all my potatoes, flour, meal, meat, butter, applebutter, and other eatables and also two hogs such as she may choose, this is a special legacy to be in lieu of services by said Rebecca and husband for me.

Sixth: I give and bequeath unto my four sons all my wearing apparel, to be divided among them as they deem proper and it is my will that this wearing apparel and the articles which by the fifth Item I have given to Rebecca shall not be included in the inventory nor in the account of my Executors.

Seventh: It is my will and I direct that each of my Executors shall have fifty dollars commission or compensation for settling my Estate and no more.

Eighth: It is my will and I order that the accounts charged in my family book against my children, shall be taken in account and equalized among all my children, by my Executors.

Ninth: It is my will and I do order that my Executors shall procure and erect a gravestone at my grave, of the same size and quality as that of my wife.

And Lastly: I nominate, constitute and appoint my sons George Moll and Jacob Moll to be the Executors of this my will and declare this and no other to be my last will and testament. In witness whereof I have hereunto set my hand and seal the twenty seventh day of January Anno Domini eighteen hundred and sixty.
