1880 Perry Twp
To the Honorable the Judges of the Orphans Court of Berks County.
The petition of the subscribing heirs and legal representatives of John Heckman late of Perry Township, Berks County aforesaid deceased respectfully represents that the said John Heckman lately died intestate, leaving a widow to wit: Rachael Heckman and issue seven children to wit: Joel Heckman, Monroe Heckman, Maberry Heckman, Morgan Heckman, Franklin Heckman, Caroline Peters wife of Charles Peters, late Caroline Heckman and Matilda Moyer, wife of Benjamin Moyer, late Matilda Heckman. And that said John Heckman died seized in his demise as of fee, of and in five certain tracts of land, as follows, to wit;
No.1 – All that certain tract of land, and tenements situate in the township of Perry (late Windsor) and County aforesaid, bounded and described as follows, to wit; Beginning at a stone there by land now a late if George Setzer and Jacob Hollenbach it 21½ degrees west 143 3/10 to a stone, thence by land of the late john Hoffman, south 68° west 19 4/10 perches to a stone, thence by land late of William Mervine, south 6½ degrees west 116¾ perches to a stone, thence by land late of John Seiger, south 72° east 58¾ perches to a black oak, and north 74° east 29 perches to the palce of the beginning. Containing 42 acres 60 perches strict measure (as per deed recorded in deed book a Vol 68 page 566te).
No. 2 – All that certain tract of land messuage tenement and tract of land situate in Perry Township aforesaid, beginning at a stone, thence by land late of John H Kershern south 68° west 45¼ perches to a stone, thence by same and by land of late John Weidman, south 22° east 39 perches to a stone, thence by land of late Charles Place and other lands of said John Heckman, north 68° east 45¼ perches to a stone, thence by land of Jacob G Hoffman north 22° west 39 perches to place of beginning. Containing eleven acres more or less (as per deed recorded in deed book a Vol 68 page 567te).
No. 3 – All that certain tract of land messuage tenement and tract of land situate in Perry Township aforesaid, beginning at a stone, thence by land late of John H Kershern south 68° west 45¼ perches to a stone, thence by land of the said John Heckman, deceased, south 22° east 39 perches to a stone, thence by the same and lands late of Jacob Hollenbach, north 68° east 45¼ perches to a stone,thence by the land late of Jacob Hollenbach north 22° east 39 perches to palce of beginning. Containing eleven acres, more or less, (as per deed from Jacob G Hoffman & wife, dated Apr 1 1867 – yet unrecorded).
No. 4 – All that certain tract or piece of woodland, situate in Windsor Township, said Berks County, beginning at a stone, thence by land of Charles Heckman west 13° west 76½ perches to a stone, thence by land of late John Bailey, south 77° east 10½ perches to a stone, thence by the same south 13° west 76½ to a stone, thence by land late of William Merkel, south 77° west 10½ perches to the place of beginning. Containing five acres, more or less (as per deed fro Adam Heckman & wife, dated March 31, 1864 – not recorded).
No. 5 – All that certain piece of ground, situate in Perry Township, Berks County. Beginning at a stone at the Schuylkill Canal, thence by lot of Monroe Heckman, north 55° east 187 feet to a stone, thence along a fifteen feet wide alley, north 36½° west 30 feet to a stone, thence by lot now in late of Benjamin Long, south 55° west 188 feet to a stone, at the Schuylkill Canal, thence along the same south 38° east 30 feet to the place of beginning. (Containing about 30 perches, more or less ( as per deed from John Munch & wife, dated April 21 1875, not recorded).
Your petitioners therefore pray the Court to appoint and order Benjamin Weidman, Henry Engle and George Balthaser (who have been chosen by your petitioners for that purpose) to make partition of the premises aforesaid to and among the children and representatives of the said intestate in such manner and such proportions as by the Laws of this Commonwealth is directed, so each one shall have and receive one – seventh part thereof, if such partition can be made without prejudice to or spoiling the whole; but if such partition cannot be made thereof as aforesaid, then to value and appraise the same, and make report of their proceedings herein according to Law.
