Petition of Jacob Weitzel

To the Honorable the Judge of the Orphans Court of Berks County

The Petition of Jacob Weitzel, eldest son and heir at law of Jacob Weitzel the elder, deceased, late of the Borough of Reading and county of Berks

Respectfully Showeth

That your Petitioner, late father died intestate leaving two sons, two wit, Jacob Weitzel, your petitioner and John Weitzel and one daughter to wit, Sarah intermarried with William Wilson - and that the said intestate died seizzed in his demise as of fee, of and in a certain messauge or two story Brick house and lot of ground on South Callowhill Street in the Borough of Reading on the west side of the street, containing in front on said Callowhill Street North and South forty feet and in length East and West about two hundred forty feet to Lot & No 28 bounded and described as follows to wit; Westward by Lot of Anthony Bickels of which this is part northwardly by said lot No. 28, Eastwardly by the other part of said lot, and southerly by the road aforesaid - Your Petitioner therefore pays your Honor to award and inquest to make partition of the premises aforesaid to and among the children and representatives of said deceased, in such manner and in such proportions as by laws of this Commonwealth is directed, if such partition can be made without prejudice and spoiling of the whole, but if such partition can not be aforesaid, then to value and appraise the same - And further to inquire and ascertain whether the said real estate with the appertenances will conveniently accomodate one or more of the said children and if so how many and make report of their property to the next orphans court.

Inquisition

Indented and taken at the house of Jacob Weitzel, deceased in the Borough of Reading in the county of Berks, the nineteenth day of October in the year of our Lord, one thousand eight hundred and thirty three before Henry Bowman, Esquire, High Sheriff of the county aforesaid, by virtue of a Writ of Partition or Valuation, to him directed, and to this Inquisition annexed by the oaths of George Goodhart, Lewis Jacoby, William Lash, George Nachemen, Henry Reinhart, Peter Nagle, John Ritter, Daniel Herd, John Heller, Peter Aurand, Joseph Shirey, (unreadable) affirmation of Samuel Beard twelve free, honest and lawful men of your bailiwick, who upon their oaths and affirmations aforesaid respectively, do say, that they went to the Messuage and Tennement consisting of a two story brick house and lot of ground on South Callow Hill Street in said Borough bordering on the west side of said street bounded by lot of Anthony Bucket and others whereof Jacob Weitzel, the intestate in the said writ named, died seized, and then and there did find that the same could not be parted and divided to and amount the parties in said writ named, without prejudice to, or spoiling the whole thereof: - and therefore, the Inquest aforesaid on their oaths or affirmations as aforesaid, have valued and appraised the said two story brick house, lot of ground at the sum of Twelve hundred and Fifty dollars and also a frame dwelling house on the same lot of ground (adjoining said two story brick house) the inquest aforesaid have appraised at the sum of Three Hundred fifty dollars, reserving an (unreadable) between the said buildings three feet wide ten feet high, and forty feet deep for the accomadation of the owner or (unreadable) of said building privilege to the (unreadable)

In testimony whereof, as well the said Sheriff, as the Inquest aforesaid, have to this inquisition interchangeably set their Hands and Seals. Dated the day and year first above written.

Renunciation of William Wilson next of Kin to Jacob Weitzel (unreadable) decd.

To the Register of Wills of Berks County I do hereby renounce my right being next a kin in right of my wife Sarah Weitzel a daughter of Jacob Weitzel. The (unreadable) latter deceased late of the Borough of Reading, Berks County to take out letter of administration on the estate of said deceased and would request Charles Reidly if he will expect of it.
