Jacob Breidigam Estate Papers 1862 Alsace Twp.

At an orphans court held at Reading in and for the County of Berks on the Eighteenth day of December AD one thousand eight hundred and sixty two. Before the Honorable Warren J Woodward, Esquire President and David Schall and George D Stitzel Esquires associate Judges of said Court. Upon the petition of the subscribers heirs and legal representatives of Jacob Breitigam late of Alsace Township Berks County deceased, setting fourth: That the said Jacob Breitigam lately died intestate, leaving no widow but issue of eleven children to wit: Amos, Gideon, Susan wife of Benjamin Himmelreich, Catharine, wife of George Kershner, Lydia, wife of William Hetrich, Leah, wife of Daniel Himmelrich, Sarah, widow of Charles Butter, deceased, Hannah, wife of Jacob Moyer, Anna Maria, wife of Jacob Shum, and Sophia, wife of William Seyler, all being full age and that the said intestate died seized on his demise as of fee of and in All that is Certain mefsuage Tenement and Tract of Land Situate on Alsace Township Berks County bondedby the lands og Reuben Kerper, of late John Hartman, by the Public Road fro a point in said road in a line of Gideon Yoder, (late John Swan's) land and by other land of said Reuben Kerper, containing Twelve Acres and on hundred and ten perches strict measures with the appurtenances. Where as Daniel Moyer, David Sink and Josiah Herb Commissioners appointed by said Court to divide or value the Real Estate of Jacob Breidigam late of Alsace Township Berks County deceased. Made return of the order to them directed with report of their proceedings annexed. The return and valuation presented and read to the Court. Whereupon the Court on due consideration confirm the same. Same day, all the heirs and legal representatives of Said Jacob Breidigam, deceased, do here by make constitute and appoint S G Green of Reading Attorney at law, our true and lawful attorney for us to appear in open Court on the 3rd Monday next 19th day of January AD 1863. Same day a S G Green appear in open Court and refuses to accept and part of the Real Estate at the appraisement to asks that the same might be sold and prayed thd Court to grant and order of Sale to the Administrators to sell the same. Whereupon it is ordered and devised by Said Court that Joseph Breidigam administrator of said deceased, having first filed in the office of the Clerk of Court a Bond in $2500 dollars with A G Green and Francis Bright as his Sureties(?) who have approved by the Court conditioned got the faith appropriate of the proceeds of such sale according to his duty do expose to Public Sale on the premises in Alsace Township on Saturday the 21st day of February 1863. The Real Estate in said order of Partition described twelve acres and 110 perches strict measure upon the following terms and conditions viz; ten percent of the purchase money there to be paid in cash and the remains due the first of April Next due notice if said sale to be given agreeably to the Rules of Court and the act of Assembly and the next stated Orphans Court to be held in Reading in and for the County of Berks on the fifth day of March AD 1863.

To the Honorable the Judges of the Orphans Court in and for the County of Berks

The undersigned administrator of Jacob Breidigam deceased makes return as follows: That in pursuance of the purpose order of said Court mad the 19th day of January 1863 after our public notice according to law and the rules of Court, he ordered, on the 21st day of February last impose the premises and messuage described to public sale on the premises in Alsace Township and then and there sold the same to Jacob Seyler his land and assyns for the sum of thirteen hundred and one dollars($1301.00) which was the highest price bidden for the same, which sale to as aforesaid made he pays may be confirmed to the said purchaser by the amount.

Before me personally came the above names Joseph Breidigam administrator of Jacob Breidigam deceased who being duly sworn according to law deposes tha the facts set forth in the above return to the amount of sale ???? amend are here and that dispersement is not ?????? or in????tly interested in said sale from subscribers before.
