The Petition of Benjamin Seidel, Mary Heckman, late Mary Seidel, and George Heckman her husband, Frederick Seidel, Harrison Seidel, Jonathan L Seidel, Esther Seidel, by her guardian Frederick Seidel and Susan Heckman late Susan Seidel by her guardian Daniel Schmeck and Jude widow all the heirs and legal representatives of Henry Seidel late of Alsace Township deceased respectfully represent:

That the said Henry Seidel died intestate about two and a half years ago leaving issue the above named children and the said widow and that the said intestate did seized in his demise ??? fee of and in his ????? described real estate, to wit: All that certain plantation farm and piece of land lying and situate in Alsace Township said County bounded by lands of Daniel Hartman, Jacob Hinnershitz, Henry Hinnershitz Frederick Seidel and others containing fifty acres and twenty perches more or less it being the same tract of land which the said deceased purchased ofFrederick Seidel by deed bearing the date the purchase day of June AD 1845 and yet vendue with appurtances no partition in valuation of the said estate having been had for petitions pray the court to order and appoint William Knabb of Oley Township, Daniel Rothenberger of Muhlenberg Township and Samuel Kutz of Alsace Township who were charged by your partioners for that purpose to mane partion or valuation of the said premises and to make apart of them proceedings therein at the ???? a ??? Court after they shall have and parted a value the same.

That we Daniel Schmeck and Jacob Seidel of Alsace Township Berks County and State of Pennsylvania are Held and Firmly Bound unto the Commonwealth of Pennsylvania, in the sum of Two Hundred Dollars, lawful money, to be paid to the said Commonwealth, her certain Attorney or Assigned, to which payment well and truly to be made and done, we do BIND ourselves, our Heirs, Executors, Administrators, and each of us, firmly by these presents. Sealed with our Seals and dated the Sixth day of November A.D. one thousand eight hundred and fifty five

THE CONDITION OF THIS OBLIGATION IS SUCH:

That if the above bounded Daniel Schmeck Guardian of Susan Heckman wife of John Heckman, a minor child of Henry Seidel late of said county, deceased, shall at least once every three years, and at any other time when required by Orphans’ Court for the County of Berks, render a Just and True account of the management of the property and estate of said minor under his care, and shall also deliver up the said property, agreeably to the order and decree of the said Court, or the directions of Law and shall in all respects, faithfully perform the DUTIES OF GUARDIAN of said minor, then the above obligation shall be void; otherwise it shall be and remain in FULL FORCE AND VIRTUE.

In the Orphans’ Court of Berks County.

Whereas, at the Orphans’ Court, held at Reading, in and for the said County of Berks, on the 11th day of January A D 1856 6h4 described purpart of Real Estate late of Henry Seidel of Alsace Township, in the County of Berks, aforesaid, yeoman, deceased, consisting of all that certain plantation farm and tract of land lying and situate in Alsace Township said County, bounded by lands of Daniel Hartman, Jacob Hinnershitz, Henry Hinnershitz Frederick Seidel and others containing fifty acres and twenty perches more or less heretofore valued and appraised at the sum of four thousand for hundred and thirty four dollars and fifty cents lawful money of the United States, by an Inquest for the purpose held, pursuance of an order of the said court, was accepted by and adjudged to upon his paying, or securing to be paid, to Jude Seidel the widow of the said deceased, the interest of the net third yearly, and to the other heirs and legal representatives of the said deceased, their equal and proportional share respectively of the net two-thirds within one year, with interest for the 1st day of April next, and of the other third, the decease of the said widow, of and in the said valuation money. And the said Court did then and there decree, that if any debt should hereafter be sued or prosecuted, of otherwise duly made to appear against the estate of the said deceased, that a deduction of a proportional part of the same shall be made from the valuation aforesaid of several purparts of the said real estate. Therefore I the said Benjamin F Seidel acknowledge myself to owe the Commonwealth if Pennsylvania, the su of Eight Thousand eight hundred and sixty nine dollars and sixty eight cents lawful money as aforesaid, of the real estate, so accepted and adjudged to be made and levied, if default be made in the following condition, that is to say: If the said Benjamin F Seidel, his heirs, executors, administrators, or assigns, shall and do well and truly pay, or cause to be paid, to the said Jude Seidel, the widow as aforesaid, her yearly interest, and to the other heirs and legal representatives of the said deceased respectively, their equal and proportional shares respectively, of and in the said valuation money, agreeably to the said adjudication of the Court aforesaid, then this recognizance to be void, or else to be and remain on full force and virtue.

Taken and acknowledged in open Court, this 11th day of January A D 1856.

May 26th 1856 I do hereby acknowledge that I this day have had and received from the within named Benjamin F Seidel fifteen hundred and thirty seven dollars and eighty cents as follows viz $1337.80 in Real Estate and $200.00 in cash it being the greater share of the four minors below named and I do therefore release and discharge the within named Benjamin Seidel for the said sum of $1537.80 of said recognizance.

To the Honorable the Judges of the Orphans’ Court for the County of Berks;

The petition of Jonathan L Seidel and Esther Seidel minor children of Henry Seidel deceased, late of the County of Berks, by their mother Jude Seidel; respectfully represents; That the petitioners are under the age of fourteen years, and have no person legally authorized to take charge of their persons and estate. They therefore pray tie court to appoint some suitable persons their guardians for that purpose.

Apr 4th 1856 I do hereby acknowledge to have had and received full satisfaction and payment of my share and proportion of two thirds of the within recognizance and therefore release and discharge the same reserving my right to receive my share of the other third after the death of the within named widow.
