In the Orphans' Court of Berks County.
Whereas at an Orphans' Court, held at Reading in and for said county of Berks, on the 6th day of August A.D. 1830 the Real Estate late of Henry Heffner of Upper Bern township, in the county of Berks, aforesaid yeomen, deceased, consisting of a messuage tenement and tract of land situate in Upper Bern Township, Berks County, bounded by lands of Jacob Yeiserm John Miller, John Yoder, Daniel Undereavlen, Jacob Platt and the River Schuylkill and containing two hundred and two acres, the same more or less, heretofore valued and appraised at the sum of three thousand two hundred and twenty five dollars, lawful money of the United States, by an Inquest for the purpose held, in pursuance of an order of the said Court, was accepted by and adjudged to Jacob Heffner eldest son of the said Henry Heffner, deceased, upon his paying, or securing to be paid, to Elizabeth the widow of the said deceased. The interest of the nett third yearly, and to the other heirs and legal representatives of the said deceased, their equal and proportional shares respectively of the nett two thirds within one year, with interest from the 1st day of April 1831and of the other third, at the decease of the said widow, of and in the said valuation money. And the said court did then and there decree, that if any debt or debts should hereafter be sued or prosecuted, or otherwise duly made to appear against the estate of the said deceased, that a deduction of a proportional part of the same shall be made from the valuation aforesaid of the said real estate… Therefore I the said Jacob Heffner acknowledge myself to owe to the Commonwealth of Pennsylvania the sum of six thousand four hundred and fifty dollars lawful money as aforesaid, of the real estate, so accepted and adjudged to be made and levied, if default be made in the following condition, that is to say. If the said Jacob Heffner his heirs, executors, administrators or assigns, shall and do well and truly pay, or cause to be paid, to the said Elizabeth the widow as aforesaid, her yearly interest, and to the other heirs and legal representatives of the said deceased respectively, their equal and proportionable shares respectively, of and in the said valuation money, agreeably to the said adjudication of the court aforesaid, then this recognizance to be void, or else to be and remain in full force and virtue.

I Joseph Heffner, one of the sons of Henry Heffner decd. do acknowledge that I have received full satisfaction of my share and proporty of the Estate of the said Henry Heffner decd. both that part which I have to receive the 6th day of August 1830. As wells as what I had to receive on the death of the widow as it her third part in anticipation of that event. I therefore full release the within recognizance of as I an concession. I Daniel Althaus, intermarried with Elizabeth, a daughter of Henry Heffner deceased, do acknowledge that I have received full satisfaction for the whole of the share of my wife (the said Elizabeth) in the Estate of said Henry Heffner decd and lastly the part in the remaining third of the widow in the said Estate of the recognizance given by Jacob Heffner the acceptant in said recognizance named and hereby release the said Jacob Heffner this 14th day of August A.D. 1843 forever.
