The petition of Charles R. Weitzel, Mary Shoup and Henry Shoup, her husband, Sallie Witmoyer and William Witmoyer, her husband, Emma Sheidy and Walter Sheidy, her husband and Jennie E. Snyder and Irvin Snyder, her husband, being all the children and heirs of Harrison B. Weitzel, dec'd, respectfully set forth: -
That Harrison B. Weitzel died on January 17, 1911, in Lower Heidelberg Township in Berks County, Pa. and left to survive him five children, to wit, the said Charles R. Weitzel, Mary Shoup, Sallie Witmoyer, Emma Sheidy and Jennie E. Snyder.
That said Harrison B. Weitzel, died intestate, seized in his demesne as of free, of the following real estate, to wit: -
Purpart No. 1. all that certain messauge or tenement and tract of land, situation in Lower Heidelberg Township, in Berks County Pa., bounded by lands of Charles Peiffer, Walker Parsons, Franklin Hartman, Isaac Isecovitz, and by Purpart No 2 hereinafter described, containing fifty seven acres, more or less.
The improvements consist of a large two story brick dwelling house, brick summer house, frame swiss barn, spring house, smoke house, wagon shed, pig sty, woodshed, and other necessary outbuildings never failing water conveniently arranged, good orchard, a good orchard and land in good condition.
Purpart No. 2. All that certain messuage of tenement and tract of land, situation in Lower Heidelberg Township, in said County and state, bounded by lands of Isaac Isecovitz, Daniel Greth, Mary Keller, land late of Reyben Spayd, dec'd. Isaac Greth, Edward Keller, George Marks, William Fritz, James Miller and by Purpart No. 1 hereinbefore described, containing thirty one acres, more or less.
The improvements consist of a two story frame dwelling house, a two story log dwelling house, frame summer house, two frame smoke houses, arch, carriage house, pig-sty, wagon shed with corn crib, a small meadow and about two acres woodland.
On said Purpart No. 1, is a mortgage of $1100.00, first lein and the farm, Purpart No.1. is worth about $3500.00, and Purpart No. 2. is worth about $2500.00.
Your petitioners are all the parties having any interest in said real estate, it having vested in them descent upon the death of said Harrison B. Weitzel, dec'd. and they desire the same to be sold and converted into money for distribution.
Your petitioners therefore pray the Court to order Charles Weitzel, administrator of the estate of decedent to make sale of said real estate under the Act of Assembly of June 12th 1893, P. L. page 461.
The within petition having been presented and read the Court and due consideration grant the prayer of the petitioners and order and direct Charles R. Weitzel, administrator of the estate of said Harrison B. Weitzel, dec'd to expose the real estate in said petition described to public sale on Saturday October 21, 1911 at 2 o'clock P.M. at the State Hill Hotel (Wm. I. Fritz, Proprietor) in Lower Heidelberg Township, Berks Co. Pa, ten per cent of the purchase money to be paid cash on the day of sale and the balance on April 1, 1912 . Notice of sale to be given by advertisement in the Berks County Law Journal and in the Reading Daily Eagle and by putting up at least ten handbills in some of the most public places in the vicinity where the property is located for at least twenty days prior to the day of sale, a bond is ten thousand dollars with approved security is first to be filed conditioned for the faithful application of the proceeds of sale, with power to adjourn the sale, and return is to be made on Saturday November 11th, at 10 A. M.
