To the Honorable the Judges of the Court of Common Pleas of Berks County, now composing an Orphans' Court, in and for said county.
The Petition of George Moll one of the Sons and Heirs of David Moll late of the Township of Maidencreek, in said county, deceased. Humbly Sheweth, that the said David Moll died intestate about May 1857 leaving issue ten children to wit George Moll, the petitioner, John Moll, Daniel Moll, Samuel Moll, Catharine wife of Jeremiah DeTurk, Lucy wife of Charles Coleman, Elizabeth wife of Peter Adam, Dina wife of William Yerger, Lydia wife of William Heter, and Mary wife of Henry Buchard, and the following grandchildren to wit, Sarah Moll, Jeremiah Moll, William Moll, Thomas Moll, Stephen Moll, John Moll, children of Peter Moll, deceased all of whom are minors. The said Sauel Moll is also a minor and the following grandchildren being children of David Moll deceased to wit, Emeline Moll, Lenora Moll all of whom ar minors. That Abraham Graeff is the guardian of Samuel Moll and Daniel Saul, the guardian for Emeline, Mary and Lenora Moll minor children of David Moll, deceased, and Daniel Zerber guardian for Sarah and Stephen Moll, two minor children of Peter Moll deceased and Henry Moll guardian for Jeremiah and Thomas Moll, two minor children of Peter Moll deceased and John Kaufman guardian for John and William Moll the remaining minor children of said Peter Moll deceased, and that the said intestate died seized in his demise as of fee, of and in the following real estate to wit; a certain messuage tenement and piece of land situate in Maidencreek Township, Berks County. bounded by lands of Peter Adam, Jonathan Heter, Abraham Reeser, and the Molltown Road, containing about one fourth of an acre, with appurtenances. Your petitioner therefore humbly prays your honors to award an Inquest, to make partition of real estate aforesaid, to and among the children and lineal descendants of said intestate, in such manner and in such proportions, as by the laws of this Commonwealth is directed, if such partition can be made without prejudice to, or spoiling the whole; but if such partition cannot be made thereof, as aforesaid, then to value and appraise the same, according to law, and make return thereof to the Orphans. Court aforesaid, according to law.
