Agreement made the 25th day of January A.D. 1865 between Daniel Herb of the township of Washington, Berks County of the part and his son John Herb of the same place of the other part witnessed that the said Daniel Herb for the consideration herein after mentioned hath agreed to demise and let and hereby doth agree to demise and let unto the said John Herb his heirs and legal representatives for and during the term of his the said Daniel Herb’s natural lifetime from and after the first day of April next all that certain messuage or tenement and tract of land in said township of Washington now owned and occupied by the said Daniel Herb bounded by lands of Henry Benfield, Mathias Dotterer and others containing 11 acres more or less, with the appurtenances. In consideration of which premises he the said John Herb, shall and will give and furnish unto his said father and unto his sister Polly Herb, sufficient goods, boarding, lodging, washing and mending, during said term and shall pay the taxes and repair the fences on or for said premises during the lifetime of said Daniel Herb. Provided however that in case the said Daniel Herb or Polly Herb or either of them should need nursing in sickness and necessitate said John Herb to hire labor for that purpose then he hall be reimbursed for these expenses for his separate use the apples from one forward tree.
