Plaintiff presents his bill of $15.77 and .93 cents interest Total $16.70 Deft acknowledges the debt but refuseth to pay either part or all; hence Judgment was delayed until Jan. 18, 1896 until which time Deft. promised to make restitution either in part or as a whole. Nothing further being heard of Deft. Judgment publicly declared in favor of Plff for $16.70 and Costs.

Summons issued February 7, 1896, P.F. Spengler Constable. Returnable Feb 13 9 to 10 o'clock A.M. Served on Deft on oath by leaving a copy of the original Summons at his dwelling house with Defts wife. And now February 13, 1896, both parties appear and go into an amicable settlement. Terms as follows to wit: Deft offers to pay Plff the sum of $35.34 in full satisfaction for said claim.

Moyer of the Township of Upper Tulpehocken, in said County, Laborer, who upon his solemn affirmation according to law, saith that on Saturday January 30, 1897, in the village of Strausstown, County aforesaid, John Himmelberger of the same Township, Laborer made an assault upon the affirmant and then and there did violently beat and abuse him and further saith not.

Embezzlement
Before me, one of the Justices of the Peace in and for the aforesaid county, (the subscriber hereunto) personally appeared Francis Bordner of Bethel Township, Berks Co., who upon his solemn oath in due form of law deposes and says that a certain Henry Long of Bethel Township did in a fraudulent manner secure from him a certain note under the pretense that he the said Mr. Long would collect the money due and payable on said note and remit the amount due to Bordner on the same day; that instead of making payment on said terms Long attributed the money to his own use; and hence in a fraudulently manner embezzled said note and in a tricky way really stole the note and further says not.

On the oath of Francis Bordner, charging the Deft with having feloniously embezzle a promissory note from him with intent to defraud and cheat him out of its value. Deft entered Bail before J.B. Klinger, J.P. at Bethel, PA. for a hearing. Deft held in $500.00 Bail to appear before me Jan 11, 1898.
Parties appear.
Case settled.
