Deed between Riah Gilson and Joseph Lacey

This indenture made the first day of April in the year of our Lord one thousand eight hundred and forty five between Riah Gilson of the Township of Cumru in the County of Berks and State of Pennsylvania, and Mary his wife of the one part and Joseph Lacey of the Borough of Reading, same County and State as aforesaid, of the other part, Witnesseth that the said Riah Gilson and Mary his wife, for and in consideration of the sum of one hundred and fifty dollars lawful money of the United States, to them in hand well and truly paid by the said Joseph Lacey at and before the ensealing and delivery hereof, the receipt whereof they do hereby acknowledge and thereof do acquit and forever discharge the said Joseph Lacy his heirs, executors and administrators by these presents have granted, bargained, sold, aliened, enfeoffed, released and confirmed and by the presents do grant, bargain, sell, alien, enfeoff, release and confirm unto the said Joseph Lacy and to his heirs and assigns. All that certain parcel or lot of ground situate on the east side of South Seventh Street in the Borough of Reading aforesaid being Lot No. 44 of the lots laid out and numbered by the said Riah Gilson (party hereto) bounded and described as follows, to wit: on the west by said South Seventh Street, on the east by a fifteen feet alley; on the north by lot of ground No. 43 now conveyed or intended to be conveyed to Moses Stubbelbine, and on the south by lot of ground no. 45 now conveyed or intended to be conveyed to William W. Seider, containing in breadth north and south twenty one feet and in length east and west two hundred feet. It being part of the same premises which William Strong and Priscilla L. his wife by their deed of indenture bearing date the twenty second day of January Anno Domini one thousand eight hundred and forty four, for the consideration therein mentioned did grant and confirm unto the said Riah Gilson (party hereto) his heirs and assigns forever as in and by the said indenture recorded in the Office for Recording of Deeds &tc. at Reading in and for the County of Berks in Deed Book A, Volume 49, page 77, relation thereunto being had will appear. Together with all and singular the houses, outhouses, barns, stables, gardens, orchards, meadows, fields, fences, ways, woods, waters, watercourses, rights, liberties, privileges, hereditaments and appertenances, whatsoever, thereunto belonging or in anywise appertaining and the reversions and remainders, rents, issues and profits thereof. And also, all the estate, right, title, interest, use, trust, property, possession, claim and demand whatsoever of them the said Riah Gilson and Mary his wife in law or equity, or otherwise howsoever, of, in, to or out of the same. To have and to hold the said parcel or lot of ground situated and limited as aforesaid hereditaments and premises hereby granted and released, or mentioned, or intended so to be with the appertenances unto the said Joseph Lacy his heirs and assigns to the only proper use and behoof of him the said Joseph Lacy his heirs and assigns forever. And the said Riah Gilson for himself his heirs, executors and Administrators doth covenant, promise, grant and agree to and with the said Joseph Lacy his heirs and assigns by these presents that he the said Riah Gilson and his heirs, the said above mentioned and described parcel or lot of ground, hereditaments and premises hereby granted and released or mentioned or intended so to be, with the appurtenances unto the said Joseph Lacy his heirs and assigns against him the said Riah Gilson and his heirs and against all and every person and persons whomsoever lawfully claiming or to claim the same, or any part or parcel thereof by from or under him, them or any of them shall and will warrant and forever defend by these presents. In witness whereof the said parties to these presents have hereunto interchangeably set their hands and seals dated the day and year first above written.

Be it remembered that on the first day of April Anno Domini 1845 before me David Medary Esquire one of the Justices of the Peace of the said county personally came the above Riah Gilson and Mary his wife who severally acknowledged the above written indenture to be their act and deed and desired that the same might be recorded as such according to law. The said Mary being of full age by me duly examined seperate and apart from her said husband, and the contents thereof being first made known to her she the said Mary upon such seperate examination as aforesaid declared that she did voluntarily and of her own free will and accord seal and as her act and deed deliver the said deed, without any coercion or compulsion of her said husband. In testimony whereof I have hereunto set my hand and seal the day and year above written.
