Deed between Henry H. Manderbach, High Sheriff (Philip Foreman estate) and Isaiah [or Josiah] Schweitzer

To all People to whom these presents shall come, I Henry H. Manderbach Esquire High Sheriff of the county of Berks in the commonwealth of Pennsylvania send greeting. Whereas by writ of Fini Facias bearing seal the seventh day of February last past I was commanded that the goods and chattels lands and tenements of Philip Foreman late of Berks county yeoman, in my bailwick. I should cause to be levied as well a certain debt of four hundred dollars lawful money of Pennsylvania which Samuel Neitock lately in an county court of Common Pleas of the county of Berks before the Judges of Reading recovered against him as one dollar like money which to the said Samuel Neitock in an same court was adjudged for his damages which he sustained by occasion of the detention of that debt as for his costs and damages by him in and about his suit in that behalf expended and that I should have these monies before the Judges at Reading at the county Court of Common Pleas there to be held for the county of Berks the second Monday in April the next to and for the said Samuel Neitock for his debt and damages aforesaid whereof the said Philip Foreman convict as appears of record &c and that I should have then there that writ, and whereas by virtue of the said writ to me directed I have seized and taken into execution a certain messuage tenement and tract of land situate in Brecknock Township Berks county bounded by lands of Christian Souder, Henry Heller, John Sautzuisk, Samuel Trup, and Andrew Good containing thirty one acres more or less the improvements consisting of a one story log home, Swiss barn, lake courses, spring of water and spring house as the estate of Philip Foreman in the same writ named with the appurtenances and the residue of the execution of the said writ appeared by a certain writing filed in the court of Common Pleas of the county aforesaid by which it appeared that the said Philip Foreman responsed with and waived an inquisition on his real estate aforesaid and consented that the same might be sold upon the aforesaid writ of Fini Facias in pursuance whereof. I the said Sheriff having given due public and timely notice of the time and place of the sale did on the eighteenth day of March last past expose the premises aforesaid to sale by public vendue or outcry and sold the same to Josiah Schweitzer of the county of Berks for the sum of Four hundred and fifty-five dollars being the highest bidder and that the best price bidden for the same. Now know ye that I the sheriff for and in consideration of the aforesaid sum of Four hundred and fifty-five dollars to me in hand paid by the said Isaiah [sic] Schweitzer at and before the ensealing and delivery having the receipt whereof I do hereby acknowledge have granted bargained sold and by these presents according to the directions of the last recited writ and by force and virtue thereof do grant bargain sell unto the said Isaiah Schweitzer his heirs and assigns all the above mentioned and described premises. Together with all and singular the buildings improvements rights members and appurtenances whatsoever thereunto belonging or in any wise appertaining and the reversions and remainders and issues and profits thereof and also all the estate right title interest property claim and demands whatsoever of him the said Philip Foreman in law or equity or otherwise howsoever of in to or out of the same. To have and to hold the said premises, hereditaments and premises hereby granted or mentioned or intended so to be with the appurtenances unto the said Isaiah Schweitzer his heirs and assigns to the only proper use and behoof of the said Isaiah Schweitzer his heirs and assigns forever for such estate and under such rents and conditions as the said Philip Foreman had and held the same at and immediately before the taking thereof in execution according to the form and effects of the laws and usages of this commonwealth in such case made and provided. In witness whereof I the said sheriff have hereunto set my hand and seal dated the twentieth day of April in the year of our Lord, one thousand eight hundred and fifty-seven.
