Deed between Peter Beam and Philip Foreman

This indenture made the twenty-fourth of August in the year of our Lord Anno Domini one thousand seven hundred and ninety-nine by and between Peter Beam and Mary his wife of Caernarvon township, Berks County, State of Pennsylvania, yeoman, of the one part and Philip Foreman of the same place, yeoman, of the second part. Witnesseth that the said Peter Beam and Mary his wife for and in consideration of the sum of one hundred twelve pounds ten shillings lawful money of the United States to them in hand well and truly paid by the said Philip Foreman at and before the ensealing and delivery hereof the receipt whereof they do hereby acknowledge and thereof and of every past and parcel thereof acquit and forever discharge the said Philip Foreman his heirs and assigns by these presents have granted bargained bargained [sic] and sold and by these presents do grant bargain, sell, release and confirm unto the said Philip Foreman and to his heirs and assigns all that certain plantation and tract of land situate in the township of Caernarvon and county aforesaid. Beginning at a post north fifteen and an half degrees east thirty perches to a post thence north forty four degrees east one hundred and thirty perches to a post adjoining land of Peter Beam thence north sixty one degrees, west twenty seven perches to a post thence south forty four degrees west one hundred and forty three perches to a black oak thence south twenty three and an half degrees west twenty two perches to a post thence south twenty two degrees east thirty seven perches to the place of beginning containing twenty eight acres and twenty perches. It being part of a tract of land which George Lorah and Magdalena his wife by their certain indenture bearing date the eleventh day of April AD one thousand seven hundred and ninety-five did convey unto Peter Beam his heirs and assigns (party hereto) relation thereto being had more fully appears. Together also with all and singular the houses, outhouses, gardens, orchards, fields, ---, ---, fences, woods, ways, water, lands, rights, liberties, privileges and appurtenances whatsoever thereunto belonging or in any wise appertain thereto and the reversions and remainders, rents, issues, profits thereof and also all the estate right title interest issues property possession claims and demands whatsoever of him the said Peter Beam and Mary his wife in law or equity or otherwise howsoever of in and to the same to have and to hold the said above described tract or piece of land containing twenty eight acres and twenty perches hereditaments and appurtenances thereunto belonging and herby granted and released or mentioned or intended so to be with the appurtenances to the said Philip Foreman his heirs or assigns to the only proper use and behoof of him the said Philip Foreman his heirs and assigns forever (Except the right of making a barn and watercourse on the said land which the said Peter Beam reserves to himself his heirs and assigns &c. The dam to be made for --- not to raise the out of its natural borne on the land of the said Philip Foreman) as to the said Peter Beam and his heirs. The said hereby granted premises with the appurtenances (except as above) unto the said Philip Foreman his heirs and assigns against him the said Peter Beam and his heirs and against all and every other person, or persons, whomsoever lawfully claiming or to claim the same or any part thereof (except as above) by them or under him them or every of them shall or will grant and forever defend by these presents. In witness whereof the parties to these presents have hereunto set their hands and seals on the day and year first above written

Berks county ss: On the 21st day of August Ano Domini one thousand seven hundred and ninety-nine before me Matthias Kaler Esquire one of the Justices of the Peace in and for the said county came the above named Peter Beam and Mary his wife and acknowledged the above indenture to be their act and deed and desired the same might be recorded as such. According to law the said Mary being of full age separate and apart from her husband by me examined the contents thereof being made known. She consenting thereunto. In witness whereof I have hereunto set my hand and seal the day and year above written.
