Deed between John Haak and George Bryfogel

This Indenture Made the Twenty Seventh Day of April in the Year of Our Lord One Thousand Seven Hundred and Ninety Between John Haak of the county of Berks and Commonwealth of Pennsylvania Miller and Elizabeth his Wife of the one Part, and George Bryfogel of Maxatawny Township in the County and State Aforesaid Yeoman of the other Part Witnesseth that the said John Haak and Elizabeth his Wife for and in the consideration of the sum of Six Hundred and Seventy Pounds in Gold and Silver coin, Lawful Money of Pennsylvania to them I trust well and truly paid by the said George Bryfogel at and before the Delivery and Sealing hereof the Receipt whereof the said John Haak and Elizabeth his Wife doth hereby acknowledge and thereof do acquit and forever discharge the said George Bryfogel his Heirs, Executors, Administrators and Assigns by the Record Have granted bargained and sold released and confirmed and by these presents Do grant bargain and sell release and confirm unto the said George Bryfogel and to his Heirs and assigns All that certain Messuage or Tenament Grist Mill, Saw Mill, and remaining Oil Mill and ninety Acres of Land be the same more or less with the appurtenances situate lying and being in Maxatawny and Rockland Townships in the county of Berks and the State aforesaid bounded by Lands of Christian Seivert, Jacob Haak and others it being late the Estate of George Seivert deceased, which Jacob Bower Esquire High Sheriff in and for the County of Berks by Deed Poll from under his Hand and Seal duly executed Dated the ninth Day of June in the Year of Our Lord One Thousand Seven Hundred and eighty nine for the consideration therein mentioned according to the force from usage and effect of the Laws of the Commonwealth of Pennsylvania by force of a writ of Vendition Exponas Tested the Nineteenth Day of February Anno domine One Thousaand Seven Hundred and eighty nine did bargain sell release deliver and confirm the said Grist Mill, Saw Mill, and Oyle Mill and ninety Acres of Land be the same more or less with the Appurtenances unto the said John Haak (partie hereto) and to his heirs and assigns forever subject to the payment of the purchase Money, Intrest &c (if any) which may be due, or hereafter become due and payable for the same premises to the Chief Lender, Lords of the Fee thereof and to all other incumbrances whatsoever, as in and by the Sheriffs Deed Poll acknowledged in open court of Common Pleas of Berks County aforesaid recourse being thereunto had will more fully appear. Together also with all and Singular the Houses Out Houses Buildings Edifices Improvements Fields Fences Meadows Pastures Waters Races Dams Freeboards Forbes Ponds of Water Water Courses Ways Woods Underwoods Rights Lights Easements Members Liberties Priviledges Hereditaments and Promises with the Appurtenances whatsoever thereunto belonging or in anywise appertaining and the Reversions of Remainders Rents Issues and Profits thereof and all the Estate Rights Title Interest Uses Trust Benefits Possesion Property Claim and Domain whatever of from the said John Haak and Elizabeth His Wife and their Heirs of into and out of the same premises or to any part thereof To Have and To Hold the said Messuage or Tenament Grist Mill Saw Mill and Remaining Oyle Mill and ninety Acres of Land more or less aforesaid Hereditaments and Premises Hereby granted or mentioned or intended to be with the Appurtenances unto him the said George Bryfogel his Heirs and Assigns To the only just use Benefit and Behoof of him the said George Bryfogel his Heirs and Assigns forever Under and Subject to the reservation in the above part recited Sheriff Deed Poll mentioned and referred And the Said John Haak and Elizabeth his Wife for themselves and their Heirs Do Hereby Covenant Promise and Grant to the said George Bryfogel his Heirs and Assigns that the said John Haak and his Heirs the said hereby granted Messuage or Tenament Grist Mill Saw Mill and remaining Oyle Mill and ninety Acres of land be the same more or less Hereditaments and Premisies hereby granted or meant mentioned or intended so to be with the Appurtenances unto him the said George Bryfogel his Heirs and Assigns Against him the said John Haak and Elizabeth his Wife and their Heirs and against all and every other person or persons whomsoever lawfully claiming or to Claim the same or any part or parcel thereof by from or under him them or any of them Shall and will Warrant and forever Defend by these Presents. In Witness whereof the said Parties to these Presents have interchangeably together Hands and Seals hereunto Dated the Day and Year first above written

Received the Day of the Date of the above Indenture of the above named George Bryfogel the just and full sum of six hundred and seventy pounds in Gold and Silver Coin lawful money of Pennsylvania. It being the Consideration Money for the above granted Premises in full Today received by me

Personally came before me the subscriber and one of the Justices in and for the said County of Berks John Haak and Elizabeth his Wife the grantors above named and acknowledged the Above Written Indenture to be their Act and Deed and defined the same to be recorded as such. She the said Elizabeth being of full Age secretly and apart by one examined of the contents Thereof first made known unto her the voluntary consent thereto. Witness my Hand and Seal the Day and Year first above written.
