Land Deeded to Philip Waggoner by John George Schall (and in which document JOHN BOOGHS is shown to own land in Bern Twp in 1754)

THIS INDENTURE Made the twenty seventh day of March in the Year of Our Lord one thousand seven hundred and sixty two BETWEEN John George SCHALL of Bern Township in the County of Berks yeoman and Juliana his wife (unreadable abbreviations) of the one Part and Philip WAGGONER of Heidelberg in the County aforesaid Yeoman of the other Part WHEREAS a certain Stephen UNBEHAUEN in or by a certain Deed of (unreadable) Bargain & Sale bearing the date the eighth day of June Anno Domini 1748 for the Consideration therein Mentioned did give grant bargain and sell unto a certain Conrad SCHARFF then a Quantity of One Hundred Acres of Land situate in Bern Township aforesaid / which said One Hundred Acres of Land is part of a Tract of Three Hundred Acres of Land Granted and Surveyed unto the said Stephen UNBEHAUEN by Virtue of a Warrant from the Honorable the Proprinaries (?) of the said Province / AND WHEREAS the said Conrad SCHARFF by his certain Deed of Assignment bearing date the fourteenth day of November Anno Domini 1748 did Grant, Bargain and sell into John George SCHALL aforesaid (Party to these presents) All that the before mentioned Tract of One Hundred Acres & of Land Together with all and singular the Apppurtenances NOW THIS INDENTURE WITNESSETH that the land Philip WAGGONER the Receipt thereof is hereby Acknowledged And the said Philip WAGGONER thereof Acquitted & forever discharged by these presents (unreadable) HATH Granted Bargained sold aliened Released enfoefed & Confirmed And by these presents He the said John George SCHALL doth Grant Bargain Sell alien Release and Confirm that the land Philip WAGONER his Heirs and Assigns All that the before mentioned Tract of Land containing One Hundred Acres or thereabouts situate in Bern Township in the County of Berks and Part of the said Tract of Three Hundred Acres surveyed unto the aforementioned Stephen UNBEHAUEN Together (unreadable) with all and singular the appurtenances and all the Buildings & Improvements thereon TO HOLD . to have the said Philip WAGGONER his Heirs and Assigns for ever Under and Subject to all & singular the Reservations Covenants and Provisions in the said Proprietary Warrant Mentioned & Comprized AND WHEREAS the said John George SCHALL obtained a Proprietary Warrant bearing date the 15 day of May Anno Domini 1759 for the taking Up and surveying a Tract of Fifty Acres of Land more or less adjoining Lands of the aforesaid Baltzer UNBEHAUEN in Bern Township aforesaid in the said County of Berks AND WHEREAS the said John George SCHALL obtained another Proprietary Warrant for the surveying Twenty five Acres of Land adjoining the Lands of HANS BOOGHS in the said Township of Bern which said Warrant was dated the (blank) day of April Anno Domini 1754. AND WHEREAS after a certain Frederick KIRCHNER obtained a Proprietary Warrant for the Surveying One other Tract of Land Situate in the said Township of Bern Containing Twenty five Acres of Land more or less which said Frederick KIR(C)H(N)OR for a Valuable Consideration did assign and transfer the said Warrant and all his Titleing Interest therein & therein (unreadable) the said John George SCHALL as in & by the (?) Assignment bearing date the nineteenth day of June Anno Domini 1752 may appear (which said last Tract of twenty five Acres is adjoining the Lands of John SCHNEIDER and John TURNBACH in the said Township of Bern) NOW THIS INDENTURE FURTHER WITNESSETH that the said John George SCHOLL for and in Consideration of the sum of One Hundred and Five Pounds full Money of Pennsylvania to him in hand paid All and before the ensealing and Delivery hereof the Receipt, whereof the said John George SCHOLL doth hereby acknowledge and the said Philip WAGGONER thereof doth acquit and for ever discharge by these Presents HATH Granted bargained and Sold And my these Presents DOTH Grant Bargain and sell Unto the Said Philip WAGGONER his Heirs and Assigns All those the beforementioned three Several Tracts of Land Situate in Bern Township with all and singular the appurtenances (unreadable) and Also all the Right Title Interest Property Claim & Demand whatsoever of him the said John George SCHOLL of in or to the same TO HOLD the said three several Tracts of Land aforementioned. Hereditaments and Promises Together with the Appurtenances unto the Said Philip WAGGONER his Heirs and Assigns under the Several (unreadable) and Covenants in the respective Warrants contained and (unreadable) IN WITNESS whereof the said Parties to these Presents have hereunto Interchangeably for their Hands and Seals the Day and year first above written ~ Hans Georg SOLL (seal) Julia O. Do. 1763, before me Jonas SEELY one of the Justices (of Peace) for the County of Berks came the above Named John George SCHALL (seal) and Stephan FIDLER one of the Subscribing Witnesses to the above indenture the said John George SCHALL acknowledged the above Indenture To be his Act and Deed and desired that it Maybe Recorded as Such and the said Stephan FIDLER On his Solemn Affirmation Doth Declare that he was Present and Saw Juliana the Wife of the said John George SCHALL Sign and Seal the above Indenture in Testimony whereof I have Hereinto Set my Hand and Seal the Day and Year above written. ~ Jonas SEELY (Upon which acknowledgment and (unreadable) there is (unreadable) the following Deed and Acknowledgment) KNOW ALL MEN BY THESE PRESENTS that (unreadable) (unreadable) Named Philip WAGONER to whom the within(?) Lease(?) or Indenture was made for and in Consideration of the Sum of two hundred and twelve Pounds of Lawful Money of Pennsylvania to me in hand paid by John BOOGHS of Bern Township in the County of Berks and Province of Pennsylvania yeoman at or before Sealing and Executing of this Indorsement, the Receipt, whereof I do hereby Acknowledge and my self therewith fully and Intirely satisfyed HAVE granted bargained sold released and confirmed and by these Presents DO grant bargain sell release and confirm unto the said John BOOGHS his Heirs and Assigns, all and every the within Mentioned several Tracts of Lands with the Appurtenances as within Described unto him the Said John BOOGHS his Heirs and Assigns for ever UNDER and SUBJECT to the Payment of the Remainder of the Purchase Money Interest and Quitrent due or to (unreadable) due thereon to the Honorable Proprietors of the said Province aforesaid; as within Mentioned IN WITNESS whereof the said Philip WAGONER have hereunto set my Hand and Seal, Dated the twenty fifth Day of February Anno Domini 1764,

BE it remembered that on the 25th day of February Anno Domini 1764 Before me the Subscriber one of his Majestys Justices of the Peace came the above named Philip WAGONER and Acknowledged the above Written Indorsement to be his Act and Deed and desired that the same might be recorded as such and that the Name thereunto Subscribed being of his own hand Writing WITNESS my Hand and Seal, the Day and Year aforesaid, Peter STRYCHER (seal) Recorded and this Record and the Original diligently compared and found to agree exactly Word for Word on the 21st day of June Anno Domini 1766.
