THIS INDENTURE made the eighth day of January Anno Domini one Thousand Eight hundred and fourteen Between JOHN BOOKS and ABRAHAM BUCKS of Bern Township Berks County and State of Pennsylvania Yeomen of the one part, and DANIEL BUCKS of the same place yeoman of the other part. Witnesseth whereas ABRAHAM BUCKS Father to the said three sons John Abraham and Daniel in his life time, by virtue of sundry good and assurances in law truly(?) had and obtained was seized and possessed in his own dimesne of and in Two Separate Plantations or Tracts of Land in said Bern Township, and the said Father Abraham Bucks, in and by his last in the words following:to his said three sons all his said Two Tracts of Land in the words following: Thirdly, I give devise and bequeath all my landed property with appurtenances which I own in said Berks County unto my three sons John Abraham and Daniel and to their heirs and assigns forever; (unreadable) I order and it is my will that after my youngest son Daniel comes upon age, my above named three sons, shall make Partition and division of the land as good as they can among themselves which will, is since duly proved approved and record(?). And WHEREAS the Youngest son of the said Testator did arrive of his age of 21 on the Eighteenth day of October AD 1813, Whereupon the said sons did make Partition and division in the manner following, that is to say, the share dividend allotment and tract of the said DANIEL BUCKS being all that certain Messuage Tenement of two Separate Tracts of Land situate in said Bern Township, Bounded and described as follows, Beginning at a hickory by land of VALENTINE MOGUL, South Eighty six degrees, West ninety seven perches & a half to a white oak South seventeen degrees West one hundred and one perches to a White Oak South Seventy three degrees East ninety eight perches & a half to a white oak by land of JOHN LUTZ North (unreadable) eight degrees East fourteen perches and a half to a white oak South sixty six degrees East Five(?) perches to a ch. oak South Eleven (unreadable) West sixty eight perches to a small pin oak on a (unreadable for the next two lines) of said V. MOGUL South Eighty six West thirty nine perches to a hickory South two deg. East five perches and a quarter to the place of Beginning Containing one hundred thirty nine Acres and Sixty perches and the usual Allowance of 1(?) to land being the same Tract which JACOB MINICH and Catherine his wife by this Deed Sealed January 31st 1801 granted to ABR. BUCKS deceased the Testator aforesaid, and the other BEGINNING at a Black Oak in a line of Henry PHILIP North Sixty-four and a half deg. West fifty eight perches to a stone, South forty six deg. West two perches to a stone North Eighty four degrees West twenty four perches to a stone in a line of MARTIN WORTMAN North forth seven deg. East one hundred and thirteen perches to a Chestnut Oak thence by land the share allotment & part of JOHN BUCKS North twelve deg. West forty five perches to a black oak North five degrees East (unreadable) one perches and a half to a Black oak North twenty five deg. East thirty one perches & a quarter to the BEGINNING Containing Twenty-Eight Acres one thirty two perches neat, being part of ABR. BUCKS other place Together with the messuages Edifices buildings and improvements on the said described Two Tracts created Standing or being, and all the ways, woods waters water courses, rights liberties privileges, hereditaments and appurtenances whatsoever thereto belonging or in any wise appertaining: And the reversions and remainders rents (unreadable) & profits thereof TO HAVE AND TO HOLD and enjoy the same rents the said DANIEL BUCKs his heirs and assigns forever in Severatly(?), as his and their full part Share and dividend of and in all and Singular the premises. And the said JOHN BUCKS and ABRAHAM BUCKS by these presents for themselves & their heirs, give grant allot assign set over, release and confirm unto the said DANIEL BUCKS and to his heirs and assigns forever the said described two tracts or parcels of land with the appurtenances TO HAVE AND TO HOLD to him the said DANIEL BUCKS his heirs and assigns, to the only proper use and behoof of his the said DANIEL BUCKS his heirs and assigns forever in Severalty(?). And the said JOHN BUCKS and ABRAHAM BUCKS for themselves their heirs Executors and administors do Covenant promise grant and agree to and with the said DANIEL BUCKS his heirs and assigns and every of them by these presents that the said DANIEL BUCKS his heirs and assigns shall or lawfully may from time to time and at all times hereafter forever freely peaceable and quietly have hold occupy possess and enjoy the above described Two Tracts or allotments of land containing together one hundred and sixty eight Acres thirty two perches with the appurtenances and receive and take the rents issues and profits thereof, without the lot suit or hinderance, molestation interruption or denial of them the said JOHN BUCKS & ABRAHAM BUCKS their heirs and assigns or of any other person or person whatsoever lawfully claiming or to claim by from or under him them or any of them shall and will warrant and forever defend by these presents -- In witness whereof the parties to these presents have hereunto interchangeably set their hands and seals Dated the day and year first written
