Deed between Jacob Hill and Jacob Feger

This indenture made the second day of April Anno Domine one thousand seven hundred seventy seven between JACOB HILL of Windsor Township in the County of Berks and Province of Pennsylvania yeoman of the one part and JACOB FEGER of Exeter Township in the county aforesaid yoeman of the other part. Whereforth that the said JACOB HILL for and in consideration of the sum of four hundred pounds lawful money of Pennsylvania to him the said JACOB HILL will and truly in hand paid by the said JACOB FEGER at or before the ensealing and delivery of their presents the parcel thereof doth acquit exonerate and discharge for ever the said JACOB FEGER his heirs and JACOB FEGER his heirs and assigns for ever all that certain piece or parcel of land situate lying and being in Windsor Township in the County of Berks and Province of Pennsylvania aforesaid (it being part of the same piece or tract of land which a certain ROBERT JONES obtained an application for from the Honourable the Proprietaries of the Province aforesaid and whereas the said ROBERT JONES and ELISABETH his wife by their instrument of writing and for the consideration therein mentioned granted bargained and sold the same to DANIEL HILL his heirs and assigns, and whereas the said DANIEL HILL by his deed poll under his hand and seal bearing date the tenth day of March Anno Domine one thousand seven hundred and sixty seven did for the consideration therein mentioned grant bargain and sell the same to JACOB HILL party hereto. Bounded and described as follows beginning at a post thence south fifty degrees east two hundred and twenty six perches by land of HUGH JONES and vacant land to a post thence forty degrees north east one hundred and seventy perches by vacant land to a post thence north fifty degrees west two hundred and twenty six perches by vacant land of THOMAS SHEPPART to a post thence south forty degrees west one hundred and seventy perches by land of THOMAS BELLANCE to the place of beginning containing in the whole two hundred and twenty six acres and eighty five perches of land with the usual allowance of six percent for roads, etc., as by the surveyors draught of the same may more fully appear) It being part of the aforementioned tract and only containing one hundred and fifty six acres of land and eighty perches be the same more or less together with all and singular the houses out houses edifices and buildings therein erected and built profits commodities advaritages emoluments heredetaments reversion and reversions remainder and remainders rents issues and profits thereof and also all the estate right title interest use trust property possession claim and demand whatsoever of him the said JACOB HILL of in or to the same or every or any grant thereof and also all deeds evidences and writings touching or concerning the same or any part thereof and now in the custody or possession of him the said JACOB HILL or which he can or may come by without [ ] at law or equity to have and to hold the said piece or parcel of land heredetaments and premises hereby granted with the appurtenances unto the said JACOB FEGER his heirs and assigns to the only proper use benefit and behest of him the said JACOB FEGER his heirs and assigns for ever.

Under and subject to the residue of purchase money and yearly [quit] rent now due and hereafter to become due for the same to the chief lord or lords of the fee thereof and the said JACOB HILL his heirs executors and administrators doth covenant promise and grant to and with the said JACOB FEGER his heirs and assigns that he the said JACOB HILL his heirs and assigns and all and every other person and persons his or their heirs any thing having or claiming in the said premises above granted or meant mentioned or intended to be or any part thereof by him or under him them or any or either of them shall and will from time to time and at all times thereafter upon the reasonable request and at the proper costs and charges of him the said JACOB FEGER his heirs and assigns make do and execute or cause and procure to be made done and executed all and every such further and other lawful and reasonable act and acts thing and things conveyances and assurances on the law whatsoever and or the better more [ ] and perfect granting conveying and assuring of all and singular the said premises with the appurtenances unto the said JACOB FEGER his heirs and assigns for ever as by him the said JACOB FEGER his heirs or assigns or his or their council learned in the law shall be reasonably advised devised and required and he the said JACOB HILL his heirs the said piece or parcel of land above described and premises unto the said JACOB FEGER his heirs and assigns against him the said JACOB HILL and his heirs and against all and every other person and persons whatsoever lawfully claiming said premises or any part thereof by from or under him them or any of then shall and will warrant and for ever defend by those presents only the chief lord of the fee thereof excepted in witness whereof the said parties to these presents have hereto interchangeably set their hands and seals the day and year first above written JACOB HILL (seal)

Sealed and delivered in the presence of CHARLES SHOEMAKER, HENRY CHRIST Received on the day of the date of the above indenture of the above named JACOB FEGER the sum of four hundred pounds in full for the consideration money abovesaid. JACOB HILL witnesses present at signing CHARLES SHOEMAKER, HENRY CHRIST, Berks County.

This second day of April Anno Domine one thousand seven hundred and seventy seven before me the subscriber one of the “-”-”-”- Justices of the Peace for the county aforesaid personally came the above named JACOB HILL and acknowledged the above indenture to be his act and deed, and desired that the same might be recorded as such as witness by hand and seal the day and year aforesaid.
