Deed between Herber Berger and Daniel Ludwig

This Indenture made the tenth day of December in the year of Our Lord One thousand seven Hundred and eighty five Between Herber Berger of the Tulpehocken Township in the County of Berks in the State of Pennsylvania Yeoman and Catharine his wife of the one Part, And Daniel Ludwig of the Township and County Aforesaid Yeoman of the other part. Witnesseth That the said Herber Berger and Catharine his Wife for and in said In consideration of the sum of two hundred Pounds Lawful Money of Pennsylvania to them in Hand paid by the said Daniel Ludwig at or Before the Ensealing and Delivery hereof the Receipt whereof they do hereby acknowledge and thereof Acquit and forever Discharge the said Daniel Ludwig his Heirs Executors and Administrators by these Presents have Granted Bargained Sold Aliened Enfeoffed released and Confirmed and by these Presents doth Grant Bargain Sell Alien Enfeoff Release and Confirm unto the said Daniel Ludwig And to his Heirs and assigns A Certain Tract Piece and Parcel of Land Situate formerly in Lancaster County but Now in the Township of Tulpehocken in the County of Berks Aforesaid Bounded and Limited as follows, to wit. Beginning at a stone a corner of Daniel Heister Land, thence Extending by the Land of said Herber Berger South Eighty Degrees West One Hundred and Ninety Three Perches to A white oak thence by Land of John Long South Ten Degrees East fifty one Perches and one Quarter of a perch to a white Oak, Thence by Land of the said Daniel Ludwig North Eighty Degrees East One hundred and Sixty Nine Perches to a Post Thence by Land of the said Daniel Heister Fifty six perches and an half of a perch to the first mentioned Stone and place of Beginning, containing fifty four Acres and One Hundred Perches and the usual Allowance of six percent? for Roads to?/ Part of A Larger Tract of Land Called Lewisburg: Granted by the Common-wealth of Pennsylvania by Patent of Twenty third Day of September in the Year of Our Lord One Thousand Seven hundred and Eighty five unto the said Herber Berger, party hereto, (Recorded at Philadelphia in the Office for Recording of Deeds in Patent Book No. 4 Page 47N6a??, as is and by the said (------?) Patent Reference being thereunto had May More fully and at Large Appear/ Together with all, and Singular the Houses Outhouses Buildings Improvements Ways Woods Waters Water Courses Rights Liberties Privileges Hereditaments and Appurtenances whatsoever there unto Belonging or in anywise Appertaining and the Reversions and Remainders, Rents ????? and Profits thereof And also all the Estate Right Title Interest Property Claim and Demand whatsoever of them the said Herber Berger and Catharine his wife in Law or Equity or Otherwise of into or Out of the same. To Have and To Hold The said Tract Piece and parcel of Fifty four Acres and One Hundred Perches of Land and Allowance aforesaid Hereditaments and Premises hereby Granted or Mentioned or Intended so to be with the Appurtenances unto the said Daniel Ludwig his Heirs and Assigns. To the only Proper Use and Behoof of the said Daniel Ludwig his Heirs and assigns forever, Subject to the Proportionable Part of the Reservations and Exceptions in the above Recited Patent Reserved and Excepted for the Use of the Common Wealth And the said Herber Berger for himself his Heirs Executors and Administrators doth Covenant promise grant and Agree to and with the said Daniel Ludwig his Heirs and Assigns by these Presents that he the said Herber Berger and his Heirs The said Tract and above Mentioned and Described Piece and Parcel of Fifty four Acres and One hundred Perches of Land and Allowance Aforesaid Hereditaments and Premises hereby Granted or Mentioned or intended so to be with the Appurtenances unto the said Daniel Ludwig His Heirs and Assigns Against him the said Herber Berger and his Heirs and Against all and Every Other Person and Persons whomsoever Lawfully Claiming or to Claim by from or Under him them or any of them Shall & will Warrant and forever defend by these Presents And Further That he the said Herber Berger his Heirs and all and every Other Person and Persons whatsoever Lawfully Claiming or to Claim by from or Under him them or any of them Shall & will from Time to Time and at all Times hereafter upon the Reasonable Request and at the Proper Costs and Charges in the Law of the said Daniel Ludwig his Heirs and Assigns make do and Execute or Cause and procure to be made done and Executed all and every such further and other Lawful and Reasonable Act or Acts Deed or Deeds Device or Devices in the Law whatsoever for the further better and more perfect assurance and Confirmation of the said Tract Piece and Parcel of Fifty four Acres and one hundred perches of Land and Allowance aforesaid Hereditaments and Premises hereby Granted or mentioned or intended so to be with the appurtenances unto the said Daniel Ludwig his Heirs and Assigns as by him or them or by his or their Counsel Learned in the Law shall be Reasonably advised Devised or Required in Witness whereof the said Partied to these Presents have hereunto interchangeably set their Hand and Seals Dated the Day and Year first above Written
