Deed between Adam Styer Jr. and his wife and David Styer

This indenture made the second day of May in the year of our Lord one thousand eight hundred and sixty one between Adam Styer Jr. of Caernarvon Township, Berks County and State of Pennsylvania and Catharine his wife of the first part and David Styer of Caernarvon township, Lancaster County and state aforesaid of the second part. Witnesseth that the said parties of the first part, for and in consideration of the sum of one hundred and ninety three dollars lawful money of the United States of America unto them well and truly paid by the said party of the second part at or before the sealing and delivery of these presents the receipt whereof is hereby acknowledged. Have granted bargained, sold, aliened, enfeoffed, released, and confirmed, and by these presents do grant, bargain, sell, alien, enfeoff, release, and confirm unto the said party of the second part his heirs and assigns the land divided half part of all that certain tract or piece of meadow or pasture land situate partly in Caernarvon township, Lancaster County and partly in Caernarvon township, Berks County bounded and described as follows, to wit:

Beginning at the North east corner thereof a heap of stones thence by land of Susanna Hoffman south eighty seven degrees and one quarter west one hundred and six perches to a stone? heap thence by land of Michael Ruth south three degrees east seventy four perches to a stone? heap thence by land of George, Adam, and Peter Bard, north eighty six degrees east one hundred and six perches to a stone? heap thence by land formerly of John Schwartz, North three degrees west, seventy one perches and seven tenths to the place of beginning.

Containing forty eight acres area and quarter be the same more or less; It being the same premises which Isaac Mart Jr. and James E. Wells administrators of all and singular the goods and chattels rights and credits which were of Jacob H. Mart late of Caernarvon township, Lancaster county dec'd by their indentures bearing date the third day of April AD one thousand eight hundred and sixty one by virtue of the power and authority to them given by the Orphans Court of Lancaster County and for the consideration in said indenture mentioned did grant and convey unto Adam Styer Jr. (party hereto) and to his heirs and assigns forever as in and by the said in part recited indenture intended to be recorded relation being thereunto had will more fully and at large appear. Together with all and singular the improvements, ways, waters, water-courses, rights, liberties, privileges, hereditaments and appurtenances whatsoever thereunto belonging or in any wise appertaining and the reversions and remainders, rents, issues, and profits thereof; and all the estate, right, title, interest, property claims and demand whatsoever of them the said parties of the first part in law equity, or otherwise howsoever of, in and to the same and every part and parcel thereof.

To have and to hold the said undivided half part of the said tract or piece of forty eight acres and one quarter of land more or less, hereditaments and premises hereby granted, so mentioned and intended so to be, with the appurtenances unto the said party of the second part, his heirs and assigns forever under and subject nevertheless to the sum of sixty four dollars and thirty three cents ($64.33). His lawful interest thereof to be paid annually to Frances Mart widow of said Jacob H. Mart deceased during her natural life and at and immediately after his death the said principal sum of sixty four dollars and thirty three cents to those who shall be legally entitled thereto. And the said Adam Styer Jr. and Catharine his wife for themselves their heirs, executors and administrators, do by these presents covenant, grant and agree to and with the said party of the second part his heirs and assigns that they the said parties of the first part and their heirs all and singular the hereditaments and premises herein above described and granted, or mentioned and intended to be with the appurtenances unto the said party of the second part his heirs and assigns against them the said parties of the first part and their heirs and against all and every other person or persons whomsoever lawfully claiming or to claim the same or any part thereof, by, from or under him them or any of them shall and will warrant and forever defend. In witness whereof the said parties of the first part have hereunto set their hands and seals. Dated the day and year first above written.

Rec'd the day of the date of the above indenture of the above named David Styer the sum of one hundred and twenty eight dollars and sixty seven cents which with the sixty four dollars and thirty three cents to be price as above stated being in full for the consideration money therein mentioned.

Berks County, ss: On the second day of May AD one thousand eight hundred and sixty one before me the subscriber one of the Justices of the Peace in and for said county personally appeared the above mentioned Adam Styer Jr. and Catherine his wife and in due form of law acknowledged the above indenture to be their act and deed and desired the same might be recorded as such and the said Catherine being of full age and separate and apart from her said husband by me therein privately examined and the full contents of the above deed being by me first made known unto her did thereupon declare and say that she did voluntarily and of her own free will and accord sign, seal and as her act and deed deliver the above indenture without any coercion or compulsions from her said husband. Witness my hand and seal the day and year aforesaid.
