for John Zelner: The petition of
John S. Hoot, administrator of the estate of John Zelner Sr. late of Nocksamison
Township and who died intestate, was presented and read representing that the
said deceased died leaving a widow named Catharine and nine Children and the
representatives of two deceased by, Fredrick, John Peter, Charles, and Samuel
Zelner. Mary married John Wolfinger, Hannah married Michael Fabian, Sarah
Married to Jacob Keyser, Maria married to John S. Hoot, and the children of
Elizabeth Fluck deceased are Amos Mary married to John Sam. But Catharine and
Elizabeth of who are in their minority. Samuel Fluck the husband of said
Elizabeth is still living and the Children of Catherine Fabian whose husband
Michael Fabian is still living, are Elizabeth Saline married to Malcom Deihl and
Susanna married to Joseph Deihl. Samuel, Mary and Elavine the last two of whom
are in their minority. That the personal estate of the said deceased is
insufficient for the payment of his debts and the maintenance and education of
his minor Children by the account. Herewithin established appears and that the
said intestate seize in his demises as fee of and in a certain and three
messuage and lots of land: 1) situated partly in Nockamison Twp and Hackock Twp
containing about fifty acres of land bounded the lands of William O Campbell,
Fredrick Selner, and others 2) a wood lot in Haycock Twp containing three acres
and ninety-five perches of land bounded by lands of William Trauger and others
3) a lot of unpatented Lands containing 21 acres in said township bounded by
lands of Nicholas M Carty and others being all the real estate of said decedent
wherever situated so far as had come to the knowledge of your petitioner there
prays the court grant an order for the sale of the said real estate for the
payment of the said decedents debts. WHEREAS September 13th 1841 the Court
grants an order of sale agreeably to the prayer of the Petitioner and approved
of Fredrick Selner and David White as (?) of said trust.
