LAST WILL OF FRANCIS HUEY
In
the name of God, Amen, I Francis Huey of the Township of Coolspring,
Mercer County and State of Pennsylvania, being weak in body, but of
sound and perfect mind and memory, do make and publish this my
last will and testament, in manner and form following, that is to say;
First, I order and allow that all my just debts and funeral expenses be
paid out of my personal property by my exectutor herein after named;
and if anything remains I allow it to be given to my daughter
Elizabeth. I do also give and devise unto my son Francis Huey the tract
of land in Coolspring Township which was the estate of my son Robert
Huey, dec., my other sons and daughters having relinquished their right
or claim to the same. I do also give and devise to my son John Huey all
that part of the tract of land on which I now live, lying and being on
the north side of the Mercer and Franklin Road, subject however to the
following sums which I bequeath to my Daughter Mary, married to James
Bestwick and to be paid by my son John as follows ____ twenty dollars
to be paid one year after my decease, and twenty dollars yearly until
the sum of one Hundred dollars be paid to her, but if she should die
before the time expires, then the payments to cease, and it is my will
and direction that the above sums operate as a lien on said land until
the above annuities be fully discharged and paid, at which time the
title is to be absolutely in my son John Huey. I do also give and
devise to my Son Samuel Huey all that part of the tract of land on
which I now live lying and being south of the Mercer and Franklin road,
with all the privileges and advantages thereunto belonging: Subject to
the following bequeath, which I make to my daughter Elizabeth Huey:
_____I order and allow that my said daughter shall have the privilege
of my dwelling house, with Bed and Bedding, boarding and lodging with
everything, necessary to make her comfortable in health, with the aid
of a suitable physician in sickness during her natural life; but if she
the said Elizabeth should marry, then I order that Samuel, in lieu of
the aforesaid provision shall pay to her the sum of twenty dollars
yearly until she receives one hundred dollars, but if she should die
before the whole is paid then the payments to cease, I will and direct
that the foregoing bequests operate as a lien on the land devised to
Samuel until the whole be fulfilled as above directed, at which time
the title to the land above described shall be vested absolutely in my
Son Samuel Huey. I also give and devise to my sons George Huey
and David Huey all that certain tract of land lying and being in the
County of Venango, and conveyed to me by Baldwin and Barlow by deed
bearing ___the twenty second day of May on thousand eight hundred and
twenty four, the said tract to be as equally divided between the said
George and David as maybe having regard to quantity and quality: which
several tracts of land I give and devise to my sons as above described
and to their heirs and assigns forever subject to the reservations made
above.
And further I do herby constitute and appoint my trusty
son Samuel Huey and Nicholas Mouser Executors of this my Last will and
testament; hereby revoking all former wills by me made In witness whereof I have hereunto set my hand and Seal, the thirtieth day of September Anno Dominis One thousand eight hundred and forty one.
